Two important exceptions to the per-country ceilings have been enacted in the
past decade. Foremost is an exception for certain family-sponsored immigrants.
More specifically, the INA states that 75% of the visas allocated to spouses and
children of LPRs (2ndA family preference) are not subject to the per-country ceiling.18
Prior to FY2001, employment-based preference immigrants were also held to percountry
ceilings. The American Competitiveness in the Twenty-First Century Act
of 2000 (P.L. 106-313) enabled the per-country ceilings for employment-based
immigrants to be surpassed for individual countries that are oversubscribed as long
as visas are available within the worldwide limit for employment-based preferences.
The impact of these revisions to the per-country ceilings is discussed later in this

When they approve a case then status clearly says 'Case Approved'.
The email "we mailed the document to the applicant" may be anything or nothing, like if they transfer ur case to different service centre, they send a notice. Some time they don't send anything even though the email contradicts it. Keep checking the status, they might update it later if the case has been approved.
Also, for AP keep bugging ur attorney to see if they got it. For EAD, make sure your mail box has your name clearly, otherwise they won't deliver it.
Thanks for the thoughts. My EAD was approved last week and I already got it in mail.
I aske my attorney's office and they say "document mailed" means its approved. I dont know what to make of it, guess I'll just wait to see something in mail.

My case is very straight-forward but some really inefficient guy is making it complicated. I need your experience and inputs. Please do advise.
I came to US on J-1 in 2000. After 3-years on J-1 got 'waiver (i-612)" and then moved on to H1B visa and filed I-485 in july07 (with an approved I-140). I have stayed with the same university medical school (my GC sponsor) since 2000. Last month, I got a simple RFE --asking for a copy of approval notice of 'waiver' . Same was sent within a day and it followed with several LUDs and read rfe response received.....
Last week, got 'Notice of Intent to Deny (NOID)' for myself and same/ditto for my derivative-spouse. It is asking both of us to provide evidence/ IAP-66 and H1B approvals to prove our legal status from 2000 to 2006 (Please, note they asked only until 2006 and not until today). I have IAP-66 and H1B approvals ready to respond to this.
My Question is: Since my spouse/derivative was my dependant and was on J-2 visa, the IAP-66 were all in my name how should we respond to derivative's noid as-far-as IAP-66 approvals are concerned. We know IAPs and waiver are good for dependants and I want to end this back-and-forth with my response to uscis.
Please, advise and let me know of your thoughts....

Go on cruise. Enjoy with your family .
Also contribute to IV whatever you can. There is a on-going funding drive. Please contribute to it, if you haven't done so already .
I have seen 'IV action item threads' getting hijacked for discussions on racism, use of Gandhiji's holy name, and over other psuedo-philosophical issues and rants . A thread on Cruise to carribean getting utilized for fund-raising, We can live with that .

People do not agree and have different ideas - sometimes to the point of personal hurt! - this is natural. They have different interests and even when they have shared goals, sometimes their paths to those shared goals may diverge - this is natural, too. Yes, differences, discussion and divergence can lead to a final separation and then two or mroe new groups are born - and it can happen naturally and it does not have to be rushed or forced through censorship and persecution. But sometimes debates and differences actually help the whole group to stay together and find a better path or a better solution - in the heat of the discussion and in the fight of the dualling arguments a new idea, approach or solution is born. I do think that a lot of the most contentious discussions on this forum are actually the most important and interesting ones because those are the oens that will cut to the heart of the problem and reveal the real depths of the issues. Suppression of diverging opinions is the hallmark of dictatorships.

As far as I am concerned ... let the dogs bark ... when they start biting ...f$@king gas them ....meanwhile take a look at the "Lighten Up" thread... it should cool things down ....

Just for my understanding, why are we not talking about excluding dependents from EB count? If each primary applicant consumes nearly 2.5 visa, then excluding dependents will definitely be useful.
We don't talk about this because it is not feasible to achieve? Or does it slips out of our mind?
NB: I am not sure about the number 2.5; I remember this number from another thread.
I know it is part of IV agenda!!! But its all like wishlist.

Indian companies like Satyam had been running these farce show of outsourcing for long time, and finally the reality is surfacing up. Not only did these companies run scam with their investors but also with their clients and employees.
As a client I see them initially low balling the real cost to obtain business and when the in-house engineering capabilities have been eliminated, they will start jacking up the prices. L&T did this with us and thankfully this month we are finally kicking their a$$ out of our facility. And we will do real engineering here in USA!
Couple of years ago, I ran into an indian at one of my visa renewals outside US consulate and he told me how, Satyam forged papers to have him slip into USA on L1 and than once here convert into H1 so he can finally apply and obtain GC. All these years he worked for remarkablly low wages.
Hope Satyam scamsters see life behind bars in India!

I would add this one from Shangri-la, by Mark Knopfler:
"We may never love again, listening to the music of guitars...". That's true. Enjoy your moment today.
Since no one has come out with English translation, here is my version. oomshiva, Please feel free to correct it as you are the author
Life is short, enjoy its every moment
In Office and at Home, enjoy and just enjoy
Did get Chicken Masala, be happy with fast food
No time for gym today, walk a little and be happy
Didn't see a friend today, watch TV and be happy
Can't go to home country, make a call and be happy
Somebody is upset with you, ignore/remember him and be happy
You can't see him/her, listen to that voice and be happy
That person can't be yours, just remember and be happy
Planned to do MBA, so what if you are in software, be happy
Didn't get Laptop, With desktop be happy
Yesterday is gone, recall fond memories and be happy
Worried about future, stay in dreams and be happy
These times will pass, enjoy your present to the fullest and be happy
Life is short, enjoy its every moment
and may I add this one line
Enjoy your today to the fullest
who knows ..
there may be no tomorrow

I met an Indian who got his green card in year2003. Still he attended to give moral support to IV. Hats off to all those guys who made it to the rally even after getting there GC's. Hopefully those people who are still stuck in the GC mess realize the importance to actively participate in the events organized by IV.

Some where in the forum , some one posted (sorry I do not remember the name), that a post bill analysis will be posted. Will Post Bill Analysis , indicates what is in the Senate bill or what can we do next.

The voting part is currently over! Please read my earlier post, as some of the vote counts will be adjusted to remove votes from individuals who have the same/very similar IP as another voter for the same entry.
There seems to be a tie for 2nd place with three entries having 8 votes. Therefore, there will be some runoff voting as well.
Should be exciting :P

I have listened to the three main "Conservative" talk show hosts, Michael Savage, Sean Hannety & Glenn Beck. They are just like politicians and will do anything to retain their popularity. They are experts at twisting sentences and putting words in the caller's mouth. And when they feel they are losing the discussion, they start shouting 'GOMP' (Get Off My Phone) - very much like kids.
Sure they like the food, but thats where it ends. Their main audience is the WASP crowd.
It's better to avoid. Plus what do we stand to gain - hardly anything.

one GC for each family (3 or 4) members, instead of treating as multiple GC's.
say for a family of 4 uscis is treating it as 4 GC instead they can treat this as a single GC. which will make many people eligible for GC

I did Address change and got confirmation. After two weeks I got RFE on my I-693 and asking to fill new I-693.
