In the present situation i believe it would take around 1.5 years to 2 years if you start by preparing for labor and by the time you get your labor and new I-140.
If you ask me about audit, its better i don't scare people, i started this porting process in Jun 07 by applying labor and it got audited after a long wait it got denied, my lawyer filed an appeal and we waited for 10 months still no answer so we applied for withdrawal even that took long time and finally applied for new labor in Apr 09.. so don't get scared it doesn't happen to everyone.. maybe 1 in million case :)

Wanted to see if there is a provision to call the lockbox facility or uscis to enquire on the status of the application.
i am worried since i have not seen any activity on this for about a 4 weeks now.

Do not worry, yesterday my application was sent back saying asking for i-485 receipt as i had initially sent them I-485 transfer notice ,my application was mailed to phoenix mailbox on 5/7/10 so yes they are taking longer time ...but you should see some kind of activity for sure..do not worry

I am just trying to find out the average Lawyer Fee and Cost of GC (including Labor, I-140, 485, AP, EAD etc)
So far I have paid 8K to Lawyer and USCIS.
PERM: $1400 (case approved)
I-140: $1200 (case approved)
I-485: $1200 for primary applicant, $750 spouse, $500 per child
My company paid for H-1B and GC

Gurus/Experts,
First of all, thanks for your time and any suggestions you can provide for me to handle my case.
Here are the details:
- I am employed with a mid-size consulting/services company.
- Perm approved in EB2 and I140 filed 11/2009. I have a BE degree and 9 yrs of progressive experience before perm filing.
- Earlier this month I received an RFE asking for '60 months of exp before labor filing in form of document from current or previous employer'
- All my EB2 qualifying experience is with previous employer(a top 10 Indian IT company) as labor was filed by my current employer the same month i joined them. I was with them for 5.5 yrs
Problem:
- I was on an onsite deputation from Indian company. Before leaving for US they make you sign a bond of approx $10k and the condition is for you to return back and resign. I know that as per US laws this is not enforceable but in India this very much stands true and if you wish to fight it out you need to go thru legal systems, may not be worth the time and energy dealing with a big corporation.
- Considering the heavy amount being asked i had decided not to close my case with them as there was no impact working here in US.
- Now I need an experience letter and they are taking there own time to process my case. I doubt I can get exp. letter from them before due date of my RFE.
Possible solutions based on my knowledge:
- Get a letter on previous company letterhead from some known manager. Contacted some managers but no one seems to willing to do this.
- Get affidavits from co-workers who worked with me during the time. Already have them and had submitted to company lawyer alongwith previous co. offer letter, yearly appraisal letters and last few pay stubs. Basically, everything to prove my 5.5 yrs of work exp. was provided with the only exception of an exp. letter from previous company on its letter head.

Also there could be election year effect because most of the resources at NSC are directed to work on Naturalization cases but why to single out just EB3 cases ? Didn't they have sufficient approved EB2 140 at hand to give them a 485 ?
I never imagined being stuck for 15 months for a 140 - at the most 9-12 months was my worst case analysis. My plans of porting from Eb3 to Eb2 got ruined , job change AC21 all preparations went haywire. I've already renewed EAD card once but can't use it confidently unless this Eb3 140 is approved .

I was just quoting that there may be legitimate reasons but this is not a good reason...
It is a very sad story.
I think Karthik Rajaram, the unemployed financial advisor became insane because of financial pressure and internal family problem and did that shameful act.
It is hard to imagine two people aged 45 and 39 with three kids aged 19,12 and 7 can't survive in US - they mush have Citizenship or GC. This sad episode defenetly does not earn Indians a good name. They could have looked out and seen how so many illegal immigrants are surviving. I have heard several times that when God shuts one door, he opens another. Is it in films and story books only? I think, they have not filed for bankrupcy protection yet.

I am on currently on EAD pending AOS. My priority date is current starting September.
My wife is on H1 and serving her 3 year J1-waiver requirements she has completed 1 year and has 2 more years to go We got married two years before I started my GC process.
My question is at what point should I file my wife's I485 given that I am current next month - She obviously has a J1-visa waiver approval but has still 2 more years to complete her waiver requirements. Assuming my AOS gets approved in next 2-3 months what would you suggest would be a good time to file my wife's I-485 and I am come under EB2 India category.

Laid off 6weeks back. Attended 4 interviews. Outof luck.
I used to get many calls from desi consultants. But not now. I do not know whether it is because of economy or my EAD status.
Here are my excuses to not to get job.
1.New Father (I was little confused about how every thing goes. Thank god no set backs here)
2.Functions(I was occupied to celebrate his 21st day).
3.Taking care of new born( He needs to be feed once in every two hours. Mother got tired of this.)
4.Holiday season.
5.Economy.
6.I am good at supporting my situation :) .
Hopefully I will land some where by Jan Mid.

you are incorrect ..here and there ..there are people who have been laid off. maybe you are lucky that you are not hearing it or maybe out of the loop.
in the last 2 weeks itself, I have heard layoffs for 15 people ..so it is happening maybe slowly but surely. IT are one of the big cost savers ..most of the time, IT job is first on the block because of instant cost savings ..actually there is a different trend too (too small to notice now) ...highly paid people are being laid off and those who agree for lower salary with similar skills are being hired.

I am going to India for couple months and plans to return back on AP.I am planning to get my passport Renewal in India.Is it OK to Renew in India as it shows my India address.

I am not sure if they do police verification, even for renewals. If that is the case, there is potential for delay.
I think, renewing in the US is a fairly simple process and in most cases be accomplished in 3 weeks. There is a separate question that asks for your Indian address, so that should not pose a problem.

whatz wrong with someone who gets GC in 6 months, is'nt it our sole goal to change system to have GC in few months,
c'mon guys are you jealous, what makes you think just because you did MS here that you are more qualified than a person who has done Bcom from india, he is manager atleast he knows how to grow in a orginzation and get a GC in 6 months, so learn from him,
