I am here to talk about LEGAL immigration. In all the noise about illegal immigration and their path to legalization a very important subject is lost and that is LEGAL immigration, and delays and problems they are facing.
I came to US in 2000 with a perfect business plan and dream to start a company and spread prosperity, but the path I had to take was H1B visa. After coming here my last 9 years have been spent on getting Green Card ( I have recently filed for my 10th year H1B Extension), and my GC application with a priority date of 2003 March is still waiting in Backlog.
While there is some opposition for illegal immigration more than 90% of people I meet support the improvement in process for LEGAL immigrants. I hope in this CIR while looking at illegal immigration you pay special attention to LEGAL immigration.
Together we can build a happy and prosperous America for future generations.

I would strongly suggest to not to put your application jeopardy because what you are trying to get merge into is entirely and absolutely a different job function and you will be carrying heavy weight of questions by the concerned authority as it by no means or ways match the work what you are into currently.
It will highly likely attract the concentration. Also, I dont think the title or work of "recruiter" is a highly skilled work which the autorities will, if and for any LCA, approve as such. You dont need to be highly skilled for it. College pass outs people can do that. This much is enough for your understanding and rest is what you decide eventually.

July 23rd filer. NSC>CSC>NSC. Did not get FP notice and will be travelling to India this friday for 2 months. So called up Customer service and opened SR for both me and wife on December 20. Got appointment for me for Jan. 16th but nothing for my wife in the first week of Jan. Then a week ago got a second set of appointments both for me and wife but now on Jan. 18th.
Anyways, reported to USCIS office in Des Moines today (Jan. 16th) per original letter. Wife accompanied me and I had all the appointment letters with me. Explained to the security guy (a very nice old gentleman) about the situation with upcoming travel, etc. He went and soke with the USCIS manager and she was gracious enough to allow my wife to get her fps done with me. Was out of the place in about an hour. They had a new machine installed and the person from the machine manufacturer was demonstrating how to use to the local staff, so we were all guinea pigs. Scanned four fingers from left hand followed by thumb, then four fingers from right hand followed by thumb, this was followed by each finger individually rolled across the scanner, then took FP of right index finger and asked me to sign (similar to a credit card digital sign box). Took a photo and that was it.
One piece of interest to people who for some reason missed theit appointments and forgot to reschedule. I was informed by the security guy that there is a grace period of 87 business days after your initial appointment date for you to walk-in and get your fps done. However, you need to call the center to find out what day of the week is alloted for walk-ins. (It is Wednesday for Des Moines office).
If you have multiple appointments for different days (like I had), go to the earliest one if possible and get both the notices stamped with the stamp indicating that biometrics were taken on that date.

Following info may useful who are looking for SSN on H4
Below is part of a message I posted in another discussion, but this deserves it own discussion. If you are a legal resident of the US, such as an H4, even if you are a child, and you have an ITIN, you can get a Social Security Number, because that is the only way to get the Economic Stimulus Payment.
Be forewarned that the SSA will put up road blocks. You will likely be denied your first application. However, the law is clear and there is no cost to apply. You also have a right to appeal. A cover letter explaining why you have a RIGHT to a Social Security Number will help support your case. Your letter should refer to the laws and statutes cited below.
The only way to get the stimulus payment is to obtain a Social Security Number for "non-work" purposes. The SSA may issue an SSN to an alien under the following provision:
20 C.F.R. � 422.104(a)(3)
(i) You need a social security number to satisfy a Federal statute or regulation that requires you to have a social security number in order to receive a Federally-funded benefit to which you have otherwise established entitlement and you reside either in or outside the U.S.;

All,
This has been discussed before, but I could not find a definitive answer.
I live in Alabama and my I-485 is pending with Nebraska Service Center. Based on instructions in I-765 form, Alabama falls under Texas Service Center.
My category for I-765 EAD is -- (c) (9).
Now I am filing for my EAD renewal. Where should I send in my paper application -- Nebraska or Texas?
Would you all pl let me know. Last time my EAD was messed up big time, (wrong dates on EAD card), and I want to make sure everything goes normal this time.

You need to follow instructions. It makes no difference in processing time if your I-485 application is pending in NSC and based on instruction you need to apply in TSC and Vice Versa.
In fact I think, load sharing is going on. I applied I-765 at NSC but case is handled by MSC. Don't be surprized, that you apply at TSC and case being handled by other office.

Buddy, what were you doing for 40 days after your got terminated? If you knew it was coming you should have made efforts to transfer H1 or right after. If you transfer H1, then obviously INS will look for pay stubs etc from the last sponsoring co. Since you mentioned you never actually worked for them (if I understand this right) then you are in trouble. You can use EAD but you lose your H1 status. If you want to get back to H1 then you are back in the lottery mess to qualify for one. Obviously you need to decide what is important to you at this point. Marriage or your job/GC. Good luck.
I was in India and didn't know about it. As soon as I came to know I was under the impression it was easier to switch back and forth between EAD and H1 except that I may have to go to the consulate for visa.

The prospective H1 new-comers from India, China etc should be properly informed about the obstacles they would face in the US when applying for permanent residence.
If central Indian newspapers, for example, publish articles describing the current situation of hundreds of thousands of GC applicants, these guys would think twice before coming here and my choose to immigrate elsewhere. As a result the "brain" flow to this country will decrease. And then you will see how quickly will be resolved issues like "backlog", "retrogression" etc.
This would be one of the "negative feedbacks" which, every engineer knows that, keep the system running smoothly.
Another helpful "negative feedback" is the trend of GC applicants stuck in the system moving out of the US. Understandably, most immigrant are reluctant to take this tough step but the trend is here and it grows like a snowball.
So, let's help the Americans to keep their immigration system running smoothly by applying the proper feedbacks :-)

Should there not be a separate Green card quota for anyone with a USA Masters Degree in any field?
If USA does that, more people will pay to come to study in USA. Not go to Australia, UK etc to study. So more money to USA. And USA degree holders will be able to use this education and work in USA to improve USA economy. If they go back to their countries, then USA has brain drain.
If they have separate quota for H1, separate H1B quota for Masters Degrees, what is wrong to have one for Green Card?

I've been thru many jobs here, and none of the offer letters mentioned that the job would be "permanent" (whatever that means). It's especially not possible to have that written on job offer letters for contract/project-based jobs. In any case, UDCIS does *not* require you to mention that on your EVL.

If you are not on H1 there is no reason to inform the USCIS. Make sure that they are not including your I-140 receipt number or A#.
Actually informing that you do not have a job is sufficent to revoke your I-140.
Then how come people are saying there wont be any impact if you lose your job in EAD

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?
People here have related change of address to RFE but I personally do not blv. it happens as I changed address 3 times and nuthing adverse happened.
Wait for the RFE. It could be something minor. Since you are eb1 they might need something related to your job/experience. Each RFE is different and no one can predict what it could be. I have seen that 80-90% RFE can be replied easily so dont worry. Post again when you have information on what USCIS is asking for and I am sure that somone out here will be able to help you out.

UPDATE: My company attorney suggested talking about this in April, and I am nervous about waiting till then in limbo - things are only going bad to worse, I might as well find a job at a place which will sponsor a PERM sooner rather than later.
I request you to PM me if you have any leads for such companies might still be a good bet for filing a PERM.

I was in similar situation last year. This what my attorney told me after layoffs. They have to wait 6 months after layoffs in the company before filing PERM again. The perm filing process in big companies take atleast 2-4 months. So if they are planning to file after 6 months then this is right time to start collecting documents. For this to happen it might need little push from your manager.
If your company is in a situation where they are planning to layoff people continously over the next year(I know one big company which is doing this) then it is better to talk to lawyers right now and decide the course of action because there is no point in waiting until april. If your manager strongly supports your case then some times lawyers can pull off tricks like there are no layoff with this particular skill set or in this division etc..
I dont know of any big company that is hiring. If your resume is hot(has specialized skills) then put it in dice or monster you will always find employer.
You can always switch to consulting and find consulting company which applies for GC right away.

I was in similar situation last year. This what my attorney told me after layoffs. They have to wait 6 months after layoffs in the company before filing PERM again. The perm filing process in big companies take atleast 2-4 months. So if they are planning to file after 6 months then this is right time to start collecting documents. For this to happen it might need little push from your manager.

When is the last case for EB2 India approved?Just wanted to know the priority date of it.Mine is June 2006 EB2 when can i get my GC?Any guess?
Last I heard of is PD June 2004 Eb2 India. He got approved on July 1st.
Mine PD is september 2004 EB2 India. Hope it becomes current again in early 2008.
