Nobody from IV has prevented people from other countries from speaking up. On the contrary, multinationalism is only encouraged to give a global face to this issue. But, I don't see anyone from outside India/China bolstering IV's efforts. Why don't they step up and join the core team?

It makes no difference whether they allow concurrent filing of 140/485 or not IF YOUR EMPLOYER IS WILLING to pay extra premium processing for 140. IF not , it makes minimal difference (2-3 months delay). Earlier this year, people were getting 140 approved on 6-8 weeks on average without premium fee.
If your date is not current:
This rule makes 0 difference. File 140 and wait for approval while your date moves forward. Once its current, file 485. So everyone who is retrogressed, this rule makes no difference to you 485 filing and getting EAD/AP.
If your date is current: File 140, regular processing 2-3 months and then file 485. If you can get premium processing done then it would be 15 days and then file 485. Either ways, you are delay in filing 485 by 2-3 months. In the grand scheme of things, its negligible. It would take even 2 months for your lawyer to get the paperwork straight for filing 485.

I find it disheartening that a senior member like you would advice someone on foregoing their pleasure trip and donating to IV. Would you be willing to cancel all your pleasure trips/family outings to donate money to IV? If you do, i feel sorry for your family.
Please donate that extra money meant for leisure to IV instead going to Bahama this year.

I think ppl who have masters or above from accredited US university shouldn't have any visa restriction; meaning they shouldn't be counted towards their country quota. No cap for Masters from US University -:)

I got my H1B stamping done for 8th year in Nov 2006. When I went to the officer, just before giving my application I told that I am a returning worker. He asked for the paystubs and I gave the original ones. He approved immediately.
I took all the documents as listed in the website as well as the vfs site.
Hope this info helps.

You can enquire with the Canadian authorities if they will collect it and pass it on the US post. If not you can take a U turn once you enter Canada and go back to US to give them the I-94 and take a U turn again to re-enter Canada.

I was in a similar situation where i had two petitions one expiring in 4 months and another expiring in a year and i got the stamp for the remaining 1 year 4 months. The guys outside take only one petition as you have to schedule an appointment with only one petition (i.e. I797). When you go to the window to talk to the Consular Officer you should tell him that you have another petition and get a stamp for the entire validity of the 2 petitions. I asked the CO in a very polite way and he obliged.

So I figured BB and IV did not fell out. I for one have great regard for BB and will any day trust his/her analysis.
IMHO IV would have been much stronger with Raz4u , BB etc.
They just vanished.

Are the processing times according to the notice date or the received date ? Mine are 4 months apart.
USCIS needs to work with paper files for review/approval. RD as on your receipt is the mailroom receive date. Real receive date of a processing center is when they actually opened your file and entered in the system, which is what you see online as, "...your case was received on...". Processing centers prefer to treat this date as RD as this suites them better. In your case your true RD should be a couple of days prior to your ND. Who is responsible for the 4 months period in between when several thousand applications may have been received and entered in the system (and placed ahead of you)? Nobody.

As far as I know if the old I-140 is revoked or withdrawn before new I-140 approval one can not port PD.
My old I-140 is still active so it was safe while porting. I am not sure what happens if the old I-140 is revoked, sorry i don't have answer for this..

The fact that the National Governors Association has also endorsed "Comprehensive" reform (besides the RNC last month) strengthens the case..

Huntsman, a Republican who is proposing the resolution with Arizona's Democratic Gov. Janet Napolitano at a meeting of the Western Governor's Association, is calling for legislation to "protect and preserve the safety and interests" of the United States while also recognizing the need for "Western industries to have a stable and legal supply of workers," according to a release provided in advance of the meeting.
"Our states are on the front lines of a tidal wave of illegal immigration," Huntsman says in the release. "The debate in Washington has been polarizing and unhealthy, and we are asking the administration and Congress to adopt this bipartisan framework and recommendations agreed to by the Western Governors' Association."
Immigration has been one of the top issues of the National Governors Association as state leaders huddle in Washington.
While Congress has passed one immigration bill, there have been calls for more stringent and more comprehensive legislation from several sides of the immigration debate.
And increasingly, states are leading the charge, with Arizona and New Mexico both declaring states of emergency because of the influx of illegal immigrants.
"Governors feel they have to get into this debate because of the lack of action on the federal level in the first place," says Kirk Jowers, director of the University of Utah's Hinckley Institute of Politics, "and this issue so impacts the governors at the state level that they've decided they need to be a catalyst for this reform."
The proposal by Huntsman and Napolitano also calls for the U.S. leaders to work with Mexican and Latin American governments to "generate economic growth, improve the standard of living and promote ownership" in those countries as a way to stem the tide of immigration to the United States. Immigration was among the topics President Bush touched on during a Monday morning meeting with governors - possibly in anticipation of today's policy proposal, Huntsman said.

every drops count!! there is no single solution that would buyout all the foreclosures. Immigration is one of the major factors in fueling the economy.. folks, dont tell me that the legal immigration took away the jobs of an american.. may be one or two cases, most of the cases employers could not find any US people to fill ( high tech jobs). Letting the current non-immigrants to have GC, is not going to take away the new jobs.. all these non-immigrants are already in good paying Jobs.

Only My wife has got a medical RFE.
It talks about going to original civil surgeon and getting a TB test again and a Xray.
Did you face a similar situation as ours?
If yes can you throw some light on how to proceed.
I cannot go to the same surgeon since I live very far now.
Also worried why they have generated this RFE when I had submitted everything properly!
Anyways any guidance provided is much appreciated.

Yes we have received a similar RFE and can no longer go back to original civil surgeon. USCIS is very anal about TB test so if they don't get correctly documented result they issue an RFE. As per my lawyer many people are getting this type of RFE.
We went to a local civil surgeon and got whole test redone. Our civil surgeon did a physical but was able to get most of the vaccination records from last medical test. My suggestion will be to check with your local civil surgeon how he is willing to proceed. Most civil surgeons are not comfortable with signing documents for which someone else and would do the test again.
From what I learned from others is getting whole test done and submitting is fine. I am still in process of submitting my paper work for RFE so can not tell you USCIS's reaction for the same.
Bottom line is don't worry too much about this. but hurry up in getting an appointment with local civil surgeon as they have limited availability. :)

I hope IV does push for the 485 measure but if for whatever reason they change there mind and dont push for 485, I would be disappointed but that will in no way affect my attitude towards IV. Over the past year or so I have seen enough of core tem to say they take a decision in the best intrest of IV.

Another reason for my feeling is that AILA is not supporting I-485 filing for health care: they are supporting a temporary 25K-75K increase in GCs. It is possible that health care GC does not have I-485.
