I received a duplicate order from Hewlett-Packard. Per the customer service person I was instructed to remove the shipping label and write the return number on the box, then call Fed Ex for a pickup, all of which I did. Now, a few weeks later my credit card account has not been credited. I've called the customer service people several times, and received a transmitting tracking number for the return. I've called Fed Ex who say what I have is not adequate to track the item supposedly sitting at their warehouse. I've spoken to the supervisor at HP, and she, like everyone else, keeps referring my problem to the "return specialist", who is supposed to query Fed Ex about this, but nothing happens. Their excuse is that they don't have the actual tracking number to do this. One HP rep I spoke to told me that the return item had not been scanned since the initiation of the return, implying negligence. Yeah somebody dropped the ball. Where do I go next to get some action taken?
Dispute through credit card if possible, just tell them you sent back the item and company did not credit the amount.

Hi There,
My 485 application is pending at TSC on EB3 category, country of chargebility is Inida. Yesterday my PERM labor approved on EB2 category and need to apply 140 to recapture my own EB3 PD.

My employer will come under NSC. if the PD recaptured, I will be hardly one month away from my priority date to be current, as per the current visa bulletin dates.

So can you please provide some suggestion to which Service Center will be opt for filing EB2 140 now, in order for getting an optimal process for 140 and eventually 485?
Or does the service center really matters as it will take a very long time for me to get greened?

Theres no limit for how many YOU can have, however, there is a limit of 4 stamps that have similar themes. (4 per batch i guess you could say).

I got my GC but my wife's application (based on my 485) is still pending. I think at this point I can switch jobs/go to school full time and it won't affect my spouse's case. Just want to double check on this, any thoughts??

Hi,
I will file for my 485 this week. Next week I leave for India for 2 weeks. With the frontlog I wont get my 485 receipt this week. I have valid H1B. When I enter without 485 receipt will that be a problem? Will my 485 be abandoned in case there is problem? Please advice. Thanks.

Any legitimate company should be able to port the PD from an approved I-140 as long as it is allowed.

My current AP expires on 2 Aug 2009. I applied for renewal on 2 May and it was approved on the 20th. But the validity is only till 19 may 2010 and not 2 aug 2010.

I have lost almost 3 months here. Is it normal or a special case that i need to call USCIS?

Please advise.

They will be able to provide you an emergency AP. This has happened in the past. If you can prove the emergency, you can get AP in a few hours.

I think it is only for Mumbai Consulate(as mentioned in VFS (http://www.vfs-usa.co.in)).

"For Mumbai consular district applicants only: Drop off your required documents three working days prior to your appointment at a VFS Application Centre in Mumbai, Pune or Ahmedabad."

No where it is mentioned that HYD consulate has started. Where did you find it?

We filed our 485 on July 2nd 2007 at Nebraska office � EB3 � July 7, 2001

- The case was shifted to Texas and we received notices from Texas office with receipt date of August 27.

- Our date is now current however processing at Texas is still stuck at June 27, 2007.

- Does this mean our RD is now 08/27/07 even though it was recd. at Nebraska on 07/02/07??


Check your I-797 - receipt notice for your I-485. In that there is a received date. That is your RD. There is another field, notice date or ND that might change depending on the transfer. If the RD is different from July 2nd, you can talk to the customer service and try to get it corrected.

BTW, though they have to process in the order of RD, I don't think they are following it. From reading here and other forums, I think they are following the ND.

I work with a consulting company on client side. The client is planning a shutdown for 2 days a month - 2nd and 4th friday.

Do you guys think its gonna imapct 485 application. I am asking this question cause the labor was approved for 40/hrs per week and the salary slip shows the number of hrs worked per month which will be lesser than 160 (incase the month has 4 weeks).

BTW, I am on EAD and 140 approved couple of years back.

My wife is on H4 visa.She got an offer from Non profit organization and they are ready to do H1B.As it is Non profit Organization is that correct she can start working as soon as H1B is approved.

Is it possible to Transfer H1b in future to regular company if H1B quota exists.

Are there any restrictions involved.
