    Hello,

    My Labor was denied for the following reason -

    Neither the earliest date listed for a recruitment step on ETA Form 9089, 03/20/2008 listed in XXX and XXX, nor the date the application was filed 8/27/2008 fall within the Prevailing wage determination validity period of 4/21/200-7/20/2008. This indicates the employer did not begin recruitement, not file the application during the Prevailing wage determination period.

    Can you guys please suggest what could be done. Letter states we can ask for a review. But lawyer thinks we have start the process from the begining.

    Would appreciate susgestion ASAP. Have only 15 days to respond.

    1. Did you also enter on H1b and then switched using EAD?

    ---When i filed the EAD renewal i was still on H1B. Just filed EAD as a backup.

    2. So do you have H1B on 'Last entry status' and 'AOS pending' on 'Current status' questions?

    there is another LUD on my 485 today, continuosly from the last 4 working days Dec6th,7th,10th and today(11th)..not sure what's going on...:confused:
    It could be anything. Did you get your biometrics taken recently? People normaly would get updates after that. The first meaningful update would be something like "On xxxxx we have ordered your (green) card production". If you got that, you know you got your green card. But your PD is late than current processing date, they wouldn't adjudicate your case, even your name check is cleared. Is your name check cleared?

    I was laid off by my employer( Big staffing company) and i am in the 2 weeks notice period . I am looking for any company( desi one - reasonable) who can sponsor my H1B and also start the GC process immediately .They should be able to work with most of the vendor ( corp-corp)

    I am in my end of 6 th year and my employer is willing to give the approved 1 140 ( Eb2- Feb 2006 PD ) .

    what are my best options right now .I am looking for some advise about good company with decent track record ?

    I had pretty bad experience earlier with a chicago based desi company and then moved this big staffing firm . I am not looking for great marketing as i can manage myself.

    Hello Everyone,

    Here is my situation:

    1) My 6 years H1B with Company-A ends Sept 2011
    2) I-140 approved and my priority date is Aug 2006.
    3) Company-B(end client) offered a full-time position starting Jan 2010.

    What are my options? My questions are:
    1) Will I be eligible to extend my H1B with Company-B for another 3 years? Do I need a I-140 with Company-B to extend?
    2) Is it possible to use the labor and I-140, that I filed when I was with Company-A, to file for I-485? If I can, can I file the I-485 independent of Company-A? Do I need any kind of approval or paper work from Company-A?
    3) When Company-B sponsors my GC is it possible to port the priority date? Do I need to restart the whole GC process again with Company-B?

    I am really confused. Please help.

    (1) You can transfer your H1B for company B up to Sep 2011, but cannot extend it.
    (2) Assuming you have not filed your I-485, you can not use labor/I-140 of company A. A fresh Labor and I-140 will be required.
    (3) Priority date will be ported from your original application with company A

    My mother recently got a tourist visa for 10 years. I know that when she enters USA she will get I-94 which will be valid for 6 months, and she has to go back before the I-94 expires. My question is:

    1) Can she go back to India for say 2 months and come back to US to stay for another 6 months?
    Ex: she comes on 1st Jan 2011 , goes back 31st June 2011 , then stay for couple of months in India and Again Come Back on 1st Sep and stay for more 6 months ?

    According to my understanding tourist can stay only 6 months in USA in a calendar year, provided they don’t apply for extension, is it true?


    2) What if she comes on 1st Jan 2011 stays for 6 months, applies for 6 months extension gets it.
    Goes back in month of Dec. stays for 2 months and again comes on March 1st 2012, will she face any problem at port of entry? Due to her extension she took on her last visit?

    Please help me understand pros and corns? What is the best way to use 10 years tourist visa to stay in USA legally to Maximum period.

    You can request assistance from the airline. My elderly mother travels alone twice a year to visit me and the respective airline are always more than helpful, meeting her off the plane and making sure she knows which gate to go to etc.

    On a funny note she was most offended that they felt a wheelchair was appropriate and insisted that is only for old people. She is 77.

    You will not have problem because of H 1 B withdrawal. For that matter, even if they revoke I-140 you will not have any problem.

    But if your case is getting processed, it is possible that you get a REF asking you to provide the employment verification letter. If you can provide a valid employment verification letter at that time then you should be fine. But if you receive an interview notice instead of REF then you should also have the recent pay checks, is very important.

    In any case the only issue is if USCIS finds that you are out of Job for a longer period of time then you might run into issues. So, try to get the Job as soon as possible.

    My 6 years of H1B visa expires on Feb 2012. Can I transfer to H4 Dependant Visa on my wife's H1b Visa or F1 Visa for one year and after one year re-apply for a fresh H1B visa? or I have to go outside USA for one year and then Apply for fresh H1B Visa.
