H4 time has been decoupled from H1 time but L1 time still counts against you so it will be 72 months -40 months

Hi All,
I have a situation where I can not find proper information and would like to ask all the experts in this column.
I'm on H1B visa and have valid visa till Dec 2011. We are about to file I 140. My PD is current and I would like to do the concurrent filling. But I need to visit my home country next month for important engagement. And do not have time to get AP before I travel. I appreciate if you can find answers to my questions.
- Can I reenter to USA on valid H1B visa when my I485 is pending (without AP)?
- If so, Do I need to go for another visa stamping in my home country? (I have a valid visa, but was stamped in Mexico) & Will there be any issues for I485 application?

1) You can enter US on your H1B visa even though you might have applied for I-485.
2) You don't need to go for another visa stamping if it is valid for more then 6 months. If you are on new H1 then you must tell at the POE to put the exp date from the new H1 on your I-94.

Hi Nikith,
I guess we get FP for 485. Not for EAD or even AP.
You will get second (or even third or fourth...) Finger print notice(s)
until you get GC every 15 or 18 months.
They need to renew their FP database.

Certainly not all hospitals and universities must most do fall in the non-profit category.
Check with the HR of that org. to confirm.

All US universities and Hospitals are non-cap
the pay is less but jobs is more stable and the university will file the visa paperwork(no lawyers fees)

We (parents) had applied for family based concurrent AOS in Aug, 2008 while we were on
tourist visas. We are now in India on Advance Parole(valid till Aug. 2009) that we received
after filing AOS.
Today(Feb, 2009) production of green card has been ordered for my wife and will soon be
received in USA. My case is still pending but we expect it processed soon. Thanks for all
the help.
My questions is
(a) What documents we need to show at immigration on returning to USA?. We have I-485
Notice, Advance Parole and valid Passports.
(b) Do we need to request somone in USA to mail our green cards on receipt.?
(c) How much maximum time we still can stay in India.? We wish to stay here for another 1-2
months. In any case making travel arrangements etc. is likely to take atleast 2 weeks.
(d) But is there a time limit for returning?
(e) Can we safely enter 2-3 months after the cards are received in USA, and
(f) sending GC by mail is not objectionable?
Also, in totality, Which one of these scenarios is correct:

A receipt of notice is generated immediately. As soon as your application reaches the USCIS ofice they generate the receipt of notice and post mail it to the attorney. It takes 2-3 days for the mail to reach your attorney so we can assume that the total time to get the receipt of notice from the day it was filed should not be greater than 4-5 days.

You can do that using your EAD but that could be considered a violation of H1 status. Not big deal if you do not need to maintain H1. If you want to keep H1, you cannot do that unless you are willing to re-validate H1 later on by leaving US and re-entering on H1.

Hi All ,
I am currently on L1B visa valid till Mar 09.
I can apply for renewal for the same in Sep 09 and wanted to check if there would be any issues as if i travel to india and return on the old petition in oct-nov 08 (in case the renewal is still pending).
Will my return on the old petition cancel my L1 renewal petetion ?
I am trying to get the L1 renewed as soon as possible so that i can file for EAD renewal for my spouse.
Any views would be greatly appreciated.

Not advisable to apply for L1 extension now. You should do it after you are back from India. That is because, they will also extend your I-94 when you apply for extension (i.e the L1 extension approval notice will list your current I-94 number).
You would'nt want to end up in a state where you leave the country and return your current I-94 at the airport and CIS approves an extension on that I-94 (which you no longer have).
When you return, you will have a different I-94 that will be valid till Mar 09 and you have to file for extension again with that I-94. Alternately, you may go out of the country to get a new visa stamp before Mar 09 and re-enter with that visa stamp and get a new I-94...

I had a 10 AM appointment a couple of weeks ago and I went there at 9:30 AM and the waiting room was almost full.....But by 11 AM, there were very few people left and no new people coming in..So I was wondering they dont schedule appointments after 11 AM...Maybe they have appointments afternoon...So 11 AM should be a good time to go in....I am sure there will be a lot of people in the morning hours....

Hey here is a situation:
I have over 7 years of experience in IT
Come with a 4 year bachelor and 2 year masters from India from a non-computers background.
Have a diploma (1 year in computers)
few other computer certificate courses.
I work for Fortune's Best software company as sr. software qa engineer. My company wants to go ahead filing for my GC.
My company attorney says am not eligbile for EB2 based on the above but eligible for EB3. I am confused because I already have an EB2 being filed for future employment from a small company.
So I kind of guessing my company attorney's want to play safe to be on EB3 rather than EB2.
So what do u guys think that my company attorney is correct.
My understanding is that with the above qualifications, I am eligible for EB2.
Am I wrong????

Your first part of the question, so if I find an employer in Canada, then can I work for that company in the US without loosing the PR dates ? Are there are any complications to this ?
What about the spouse and children, can they stay in the US too or do they have to stay in Canada ?
Is the PR years counted only for the principal applicant or for all applicants?
Any help would be appreciated.

Could some one please clarify?
My wife and I were entered on AP lately and since I work for the same employer, I am still working on my H1 and am planning to extend my H1. My wife is working on EAD, can she still able to apply for H4 based on my H1? We want to have her H4 as a back-up!
