    No one can guarantee that. and that is the whole concept of "preference categories" . So now its ok for A to jump to EB2 and leapfrog everyone with his/her 2002 PD? Does 5 years of work have that much value? He/She would be ahead of 2003 EB2 filers that may have been working on degrees since 1999. That's ok by you? The faster movement of EB2 makes up for the years of education. I say, by all means BS+5 shoudl file EB2, I just don't agree with the porting. That PD was for an entirely different skill set and job. I know its the law. I still disagree. Can do that last I knew :-)

    I'm sure some of the readers would already know what I'm saying in my post and like many of them I almost stayed away from posting but for the benefit of those few ( even if it's one person) who might wonder if Gita could have been doctored I decided to share what I know .Again I felt the need to post because the idea was brought up by Sanju(NO..I'm not accusing you Sanju...nor 'm I preaching Gitaism here.Again it's just for the benefit of that few sincere folks...others can stick to Sanju's version...no harm.)

    Hindu society all through the monarchical times was blessed with Enlightened Masters who willfully(for a person who had realized the ultimate truth material positions don't matter) served as subordinates (Mahamantri, ,Rajguru )to the Kings .

    These enlightened gurus were the protectors of some of our scriptures(just some because many of the scriptures were outside the intellectual realm of many kings no matter how powerful they were) be it shastras,stotra or sutras.

    Now before one goes on a spin with these enlightened masters let me also remind everyone that none of the great works are patented or owned by any king or master(unlike in some societies). They did truly protect our scriptures so they can be passed on to us, leaving these great works for use/abuse (based on the individuals intelligence/intention) popular examples in today's world being yoga/kamasutra (both are great spiritual mechanisms but are greatly misused so much so that one can't name (one of them) without feeling wee bit embarrassed).

    If one was to trace the evil practices like caste system they wouldn't find the roots in any of these scriptures. Now these evil practices, I would say were doctored/cooked up by people/kings, but Hindu scriptures were out of the reach of these people.

    These scriptures are wired in such a way that to change them one needs to be highly evolved(not just highly educated or filled with dry intelligence) , to understand them one needs to be sincere seeker not professional seeker.

    Also Vedic Culture which is way of life, a civilization got reduced to mere religion only after foreigners came to Bharatavarsha (although the basic pillars remain the same..dharma , karma ...)

    Isn't "religion" the reason why folks are fighting? I do not mean to offend anyone, but I think all religious books have been doctored by the kings who were in power during the last two centuries. Bible, Geeta, Quran, or for that matter any religious book of any organized religion - they are all doctored from its original version. Why? Because the purpose of these books is? Guess what? To oragnize the religion. Their primary purpose is not spirituality. Because if the sole purpose was spirituality, no one will have fought each other in the name of religion for thousands of years.

    I guess the question I would ask is - WWJD ie. What Would Jesus Do? If you asked Jesus that are you the only son of god, WWJD? I can tell you with 100% surety that he will say - we are all sons and daughters of God. But con artists have doctored the holy book to suit their meaning and interpretation. Anyways, I do not mean to have a philisophical debate here with you being the "protector" of Jesus, why? Because Jesus or Allah or for that matter any great soul doesn't need any protection from anyone. Just as a cartoon cannot damage Allah, any discussion about any faith cannot damage the GOD. But too often we want to be seen as if "God is on MY side" because I follow CORRECT religion, and everyone else is against my team of "ME & GOD". And thats just the most absurd thing mankind could come up with in the form of organized religion. But the truth is, thats the most common view most humans take, everyone is protecting their "GOD", which actually sounds like a joke. Does god need any protection??? I mean give me a break.

    Please don't bring one flawed system to replace another flawed system.

    Your common sense tells you to abandon your GC because it is taking too long? Then with your defeatist mentality, you should leave the country now. In case you didn't read a word of what I said, the interest you pay is tax deductible.

    What is the difference if you had your GC or not? If you had it would you still be renting? The ONE and ONLY reason I would ever rent is if it was a rent stabilised apartment in a good location in Manhattan, or when I am saving up enough money to buy.

    It's not rocket science, just common sense. In case you are aware, lot of people on this forum don't have gc in hand. What will they do if they decide to leave due to gc taking too long to come through. Ask they bank to give back the money they spend on stupid interest for 10 years for a house upside down ?

    Common sense is to rent until you are sure you're staying for good.

    I think we all agreed that the letter contents were somewhat pre-baked. The letter campaign was a idea in the right direction.

    And mind you, we are now very active not because EB2 is moving, but because we now have concrete proof that the system was changed this year. I had my doubts, and had been asking about it for a while now, but all of the people said, "no you are wrong, the spill-over is working as it should, and as it always has". We have just recently realized that we were being misled, and there indeed has been a change. That is the reason we are being active.


    Yes, you agreed that the immigration system needs to be overhauled, but the only relief in sight is for EB2 folks.. There is no legislation that will help EB3 backlogs. Recapture will again help Eb2 folks, and given the new "pecking order" that has been wrongly put by USICS, Eb3 will never truly benefit from any of these bills.

    IV has its goals, as any organization should, and we fully realize that it can't keep everyone happy. However, some of you are stopping voices of others from being heard -- which is fine too. IV is a private organization that can choose to censor or restrict some kind of activities. But when you do that, you can't hope that everyone will support the organization, and believe everything that is being told to them.

    What you have said is completely incorrect. EB3I stands to benefit the most from visa recapture legislation. The last time visas were recaptured was in 2000 through the AC21 legislation and as a result of the 230K or so visas that were added to the pool, the USCIS was able to keep PDs for all EB categories, EB1/2/3, EBI/C/ROW, everything current for nearly 4 yrs until 2005 when those extra numbers ran out and retrogression hit. I should know, I could have filed since 2002 but delayed because my less than knowlegable lawyer advised me when you file does not matter. I did not know didly about PD in those days.
    Anyway, when you say visa recapture does not hep EB3I, that is patently FALSE. En Contraire, it is the ONLY thing that can help that category.

    Have you accounted for the increase in rent (not rent controlled) every year? Mortgage on the other hand is fixed for 30 years!



    If you buy - and take a mortgate - you end up losing (the same way you "lose" your rent)
    1. Interest you pay
    2. Property taxes you will pay forever.
    3. Maintenance you will pay forever.

    On the other hand - if you rent and,
    A. IF you pay less in rent than #1 + #2 + #3,
    B. IF you invest the remainder plus your mortgage principal amount in some other investment vehicle with superior investment returns than real estate.
    .... Then you will come out ahead renting.

    The tipping point is whether your rent equals interest + property taxes + maintenance. Based on which side is higher - either renting or buying could be good for you. I don't think there is a clear cut answer. This does not take into account the flexibility associated with renting - which is important for non-GC holders. If you assign a non-zero dollar value of $X with that flexibility, then your rent needs to be interest + tax + maintanance + $X to get to the tipping point. On the other hand, if you are not forced to save (in the form of mortgage principal payment every month) - you may just spend that money instead of investing that. If you assign a dollar value of $Y with that (probability multiplied by actual dollar value) - then the tipping point is at
    $rent = $interest + $tax + $maintenance + $X(dollar value for flexibility) - $Y(dollar value for probability of spending money instead of saving).

    Now as soon as you plug in the numbers in this equation - it will give you your tipping point and will tell you whether it is right for you to rent or to buy.

    Think about it. It is not as clear cut as you think it is. :-) Based on your earlier posts - you got an absolutely faboulous deal on your house (maybe because of your timing) and the tipping point equation would probably highly favor buying in your case. For many other (specially for those without a GC) - it may not be so clear cut.

    I don't think it's good time to buy in CA.. Just wait for option ARM reset and market will drop more.

    In California have anyone explored a Duplex/Triplex market where 2 parties buy a multiplex togather they pay less money, get a good location and good school district. I have heard a lot of success stories, plus duplex is like 2 single family homes with yards/decks etc. 2 friends buy the property togather, you also get usual tax deduction and NO HOA like town homes... (if you pay 300/mo HOA you end up paying 108000 in 30 years). I think owning a multiplex for about 5 years then renting it out and getting a single family home makes a lot of sense for long term...what say!

    Ok Dude, I will try just one last time, nobody is advocating buying a house when the market is bad. The question someone asked was is it ok to buy a house when I485 is pending, and the answer given was if he has found a very good deal, in a very good location and considering his situation if it is affordable then I485 should not be a hindrance. People who were still on H1 have bought a house when the market was good and they are doing well now. Some people who got GC might have bought a house just before the market came crashing down and they were plain unlucky. I myself bought a small affordable home when I had just my labor stage cleared. If when I bought this house the market was like this, I would not have bought but would have waited. Period.

    And for those who become nostalgic. I myself was bought up in a small house, it had only two rooms, I repeat, the whole house had just two rooms, nothing else. We had to share a toilet with 3 other houses of similar size, was I happy then?, Of course I was happy, I used to play cricket and other sports on the street with other kids with vehicles passing by once in a while. Is the situation same here?. No, but do kids here have other ways of having fun, oh yes. It doesn’t matter if the kid is living in an apartment or a house, all that matters is if he is having fun. Somebody came up with a strange logic that our love for our kids will diminish if we buy a house. If you have bought a decent, affordable house your love will not diminish, it will only manifold.

    I am not against renting, nor against people living in an apartment, I myself have lived in apartments before. I am against people who only want to save for god knows what, for people who are afraid to take small risks (for ex: buying a small home and not a mansion) when the market becomes good, they will ask you to prepare for the worst case scenario. They will say don’t buy a house because the sky will fall or don’t buy because the world will come to an end. Nothing is permanent here, not the job, not the location. You just have to take calculated risks. You just cannot console yourself saying you are from middle class and cannot do a thing, lift yourself up. If you want to buy a house but you are not doing it now because the market is bad, then I am not against you, so don’t jump on me.

    Dude - Since you did not point out the danger of buying a house in this economy(you and some others said go ahead and buy), I am pointing it. I will continue to point to the risk.

    And you are back to the point "housing is better than renting". Everyone has their own reasons to rent out or buy. I am not making a blanket statement that renting is good or buying a house is good. Where as you keep making the argument that renting is bad and buying house is good. We don't know the situation what one is in. Their jobs may be shaky. You just cannot say they made a mistake by renting. And some don't think not owning a house is a big deal. "Lift yourself up:(? (do you attend NAR seminars?)" - that is your view. Google and you will see that there are many who think buying house means wasting time maintaining.

    Given that the USCIS director doesn't visit IV before writing memos on interfiling and porting PD's it's meaningless getting your blood pressure up.

    Rolling flood is definitely free to file his/her lawsuit whether folks here like it or not and SunnySurya has every right to join in.

    Wondering why folks from EB-3 want to just move up to EB-2 and port PD. Why not go for EB-1? After all that category is current.

    If someone is eligible to port to a higher category they will rightfully do so. Your post seems to imply all PD porting is through shady means. Grow up buddy!

    The countdown to the August recess has entered its final stretch with just one week to go. But for Washington, D.C., lobbying organizations, the steamy month of Congressional downtime means a lot more than slipping out of town to sip pi�a coladas on the beach.

    It's an opportunity to contact Members back home in their districts and to mobilize constituents with issue ads and special events. The break also gives lobbyists a chance to set up along the campaign trail to push their agendas with presidential candidates in ocean-free zones such as Des Moines, Iowa.

    Usual suspects AARP, the U.S. Chamber of Commerce and the Pharmaceutical Research and Manufacturers of America plan to hit the road in August along with some grass-roots newcomers, including ONE, the organization founded by rock star Bono.

    "August is a critical month," said James Fuller, a managing director at Public Strategies Inc., which is working to shape patent legislation for the Coalition for 21st Century Patent Reform. "When Members go home they hear about all these types of issues. Now's the time when they take notice."

    Fuller's coalition plans to organize in-district meetings, letter and e-mail writing campaigns, and efforts to get its allies to be vocal participants at Members' town hall meetings. Fuller said all of this is intended to help lay the groundwork for upcoming action in September on patent reform bills in the House and Senate. Targets of the coalition's August lobbying efforts, he said, include Democratic Sens. Dianne Feinstein (Calif.) and Edward Kennedy (Mass.), among others. "We're going to be very aggressive in August, reaching out to companies in states we know we need," he added.

    Bono's ONE campaign also is planning a major effort in August, said the group's Kimberly Cadena, asking its 2.5 million supporters to speak with their Members when it comes to the farm bill and other items.

    "ONE will kick off the August recess with a grass-roots legislative briefing on the evening of August 2," Cadena said. Over the recess, ONE members, sans Bono, will be lobbying for the Education for All and U.S. Commitment to Global Child Survival bills, she added.

    Divided We Fail - a health care-focused effort sponsored by the AARP, Service Employees International Union and Business Roundtable - plans to hit the Iowa State Fair on Aug. 10 to make sure presidential contenders hear their views.

    And Bill Miller, vice president and political director with the Chamber of Commerce, said his group dispatches lobbyists on the road during every Congressional recess.

    "We decided this year to put an increased focus on doing those visits to Congressional districts and states where lots of our issues are in play and Congressional districts that are also politically in play," Miller said, adding that fundraisers also are a component of the chamber's August outreach to Members.

    Miller's team will focus on restarting the free-trade agenda, the stalled efforts on immigration reform and stymying union efforts in Congress including the card-check bill. "Whether you're a union company or mid-sized, little guy or not, the passage and enactment of something like this would have severe consequences for the United States economy," he said.

    On the other side of the political spectrum, the liberal group Campaign for America's Future is planning a barrage of targeted ads, direct mail and local press events.

    "The Campaign for America's Future plans to take the gloves off this recess to ensure that Americans are clear on who is pushing for change and who is standing in the way," said Toby Chaudhuri, the group's communications director. "The conservative minority has chosen a strategy of blocking legislation at a record pace in the Senate. We're going to expose the obstruction."

    The private equity crowd, which is working to fend off proposals to increase taxes on the industry, is planning to continue making its case during the recess, said Robert Stewart, the Private Equity Council's vice president of public affairs. "It makes much more sense for the country, for the economic growth of the country, not to single out private equity for punitive tax treatment," he said.

    America's Health Insurance Plans - which went on the air last week with ads defending the Medicare Advantage program that is on the chopping block to help pay for the State Children's Health Insurance Program - is planning to run more ads in targeted districts, depending on how this week's SCHIP debate turns out. AHIP will be working closely with seniors who use Medicare Advantage through the Coalition for Medicare Choices, said AHIP spokesman Mohit Ghose.

    "We are going to ensure that every Member of Congress understands what the impending cuts being proposed in the House mean for their constituents," Ghose said. The 400,000 volunteer members of the coalition, he added, "will go to town hall meetings and interact at the district office."

    Also on the health care front, PhRMA plans to fuel up its Partnership for Prescription Assistance bus, which will roll into several Members' districts over August, including those of Reps. James Clyburn (D-S.C.), Gene Green (D-Texas) and Tim Murphy (R-Pa.). The PPA is a pharmaceutical company program that helps pay for medicine for low-income people. PhRMA Senior Vice President Ken Johnson said the bus already has done 13 events but plans to ramp up the tour in August.

    "August is important for us because it's the one time a year when most Members are back home in their districts," he said. "During August, we have the opportunity to hold a significant number of events."

    Yes its not clear cut but lets replace your X, Y and others with numbers

    Suppose your rent is 1500$ a month

    You pay 540,000 $ in 30 years

    so your point 1 - the interest payment is always going to be less than rent if you look over the 30 year term of mortgage since there is no way to pay 540,000 dollars in interest in 30 years looking at the amortization table unless you are buying a million dollar plus house. ( I assumed 5 % rate of interest )

    2. Property taxes - these we write off from our income which again becomes pointless more or less

    3. Maintainence - Now that is a personal thing - I lived in rented apartments for many years until last year end - The property admins don't replace things on demand - so you have to live with the same old appliances , carpets etc etc until they really die off since no one is going to replace them on demand . Things break so many times as they reach the end of their life and you call the property office each time and so on.

    I would rather that I maintain my own things and have best of the market stuff rather than not.

    Some people might say there are rented places where they have top of the line stuff but remember that the rent goes higher too. So that negates that point.

    And coming to what you say in the end - my mortgage is the same as I paid for rent so renting doesn't make any sense to me. The only thing is that if I have to move back to India I will have to sell the house which I am not worried about since I live in a very good area and two houses in my lane got sold within a month last month at more than the price which I paid for my house.

    As someone said real estate is highly local. Not all places in US are losing values . There are a lot of good areas which have reached bottom. The house I bought was 20% off from the price the person whom I bought it from paid in 2005. So that is already priced in.

    The said person should have been aware of what he or she was getting into. Blaming your hardship on other people and trying to get mileage out of it is hardly an honest way............would you agree?


    Were you aware of each and every rule in the immigration law book before you applied for GC?. Did you foresee this delay before you got into this mess?.

    Shouldn't you have been aware of this option of EB3 people converting to EB2 and accounted for that when you filed your GC?. Aren;t you blaming your hardship on EB3 people and getting mileage out of it?.

    What's going on here is that approx there are 500,000 people on H1B visas in this country.

    If Anti-H1 crowd propose a bill to throw all of them out, people will laugh at them and ask them to get lost.

    So what the anti-H1 crowd has done here is "Slow bleed" as described by admin. Get rid of 8000-10,000 H1Bs out of the country each month. That way, the impact will slow and it wont send any shockwaves. IF existing H1s go to renew their H1 and the new rules apply, half of them wont fit in the new rules of "You cannot do consulting". So they will have to go back.

    These guys are trying to do what UK did to Indian and Chinese doctors. They want all of us to go back. Only difference between what UK did to doctors and what these guys want to do to us is that these guys are smarter and they are trying to get this done in slow motion. IF they take Tancredo like approach of "Everyone out, and shut the door", then it wont work.

    They have learned from Tancredo's mistake and now have adoped this slow bleed strategy of getting rid of their competition.

    Basically, they want the 1990s back. They want to roam in job market with foriegn competition, where even high-school drop-outs can get jobs of $100,000 a year by writing 20 lines of code per week.

    Man up you xenophobes. Face the competition and stop being whiny boys running to Grassley and Sessions every time you lose jobs. Get a job and get a life. Unemployment rate is 4.4 %. If you cant find jobs right now, dont blame H1B employees. Something is wrong with you.

    Every forum has its set of jokers like loveh1b. They live in their own well and think it is the world. Thats how these generalizations come.

    Don't be so harsh on people like "loveh1b". We need to educate them with the actual situation, not scare them away with such statements.

    Hopefully, loveh1b will gain from our perspectives and change his attitude towards the US legal immigration system. Not to mention, s/he can educate other people on how things work in a global economy.
