now atleast we are used to calling lawmakers. Why don't you meet the lawmakers, contact DOL etc.. make sure you have another job in hand and you can do the transfer paper work. As far as my knoweledge one can have 2 H1B at a time but can only work for one.

What IO told is correct. Untill the case 140 is not approved, EB information is not updated and IOs at the infopass has limited access.
If the 140 is approved, IOs at infopass can see this, otherwise they cant.

Pappu, I havnt got the approval notice / email yet. Will update once I have the same.
The day I got the email ( April 9 ) from TSC, I received an "unknown" call on my cell phone. I was in a meeting and was unable to take the call. Couple of days back I received a similar call and it was from an immigration officer @ TSC. She chatted with me regarding my old 140 for 2 minutes and told me that the priority date has been ported / used. I think the nice lady wanted to let me know about the approval and since I did not pick up the call generated an email from the OLD TSC system !!!!! . There is no update on the online system after wards.. I will update once I get something in regular mail..
Thanks again for all the good wishes and hopefully things will improve for all of us soon.

Mine is LC SUB PD May 2001/EB2. File on visa fiasco, no update no LUD on any file other than EAD.
So do not get angree on people who used LC SUb.
my point is don't try to forget your route and the path that you travelled to reach the point where you are today ... it is as simple as that ... anyway I should stop writing about this and rather go home early ;) ...

There are over 339,000 people stuck in name check - this is done for naturalization and 485. I can bet you this will be the next battle because a lot people who have filed 485 will get stuck in this black hole, where this no accountability by FBI to individuals because the "client" is USCIS and last quarter there were 400 law suits (Writ of Madamus etc) to force USCIS and FBI to do their jobs. It would be best if setting time limits for name checks are included in IVs goals now itself. No point in jumping from the frying pan if one is going to eventually land in the fire. The name check snares a lot of Indians, Chinese, middle easterners, russians etc. Most people stuck in the name check have never been involved with the law - go figure the algorithm FBI uses to trawl the ocean bed!
Another thought i had was...Before all of us june,july,august folks land up in the blackhole of FBI namechecks...Can we lobby for some kind of transparency?What in the world can make them take 4 yrs to check a persons name?Can they at least maintain a website that they update as and when a name check is completed...Please core and members,do something about this...something as effective as the campaign to accept july applicants!!while they are overhauling the system let them get it right all the way!!

Let them inform. Logically nothing should happen. The company wants to be in the safer side by informing USCIS.
Since you are in EAD, take unemployment and enjoy life. Hope for the best and get ready for the worst.
My company laid me off in one day without thinking a H1B guy has to leave the country immediatley. I asked them to buy my car, furniture and appartment lease as an obligation for fair value. Because of that i got 2 weeks more time to think over. Anyway they are not going to pay. Did you ask the company to pay you a return airfare to your country. If you ask, they will need time to research and you will get more free time.
This is completely wrong. Once you are in EAD and got laid off...you lose your status. There is one more thread in this forum where one guy applied for unemployed benefit in EAD, in a weeks times the ICE was coming to his home and severed the notice to appear in the court. That guy started the thread and every one bashing him for applying the unemployment benefit. But he later came to know that his employer notified the USCIS that he got laid off during EAD. So he lost his status and they wanted to deport him. I am not sure about the outcome. He is here in only in the IV. That thread was created in the last 2-3 months time. So search for it.
There is definitely some legal implication otherwise why your employer wants to inform USCIS. They wanted to be in the safer side. So if anything happens you are the one going to face the music. So check with some good attorney.

The rule that USCIS follows is that if they estimate that your priority date wil become current within a year they give you a 1 year EAD. When they estimate a wait of more than a year they give a 2 years EAD. ofcourse this is not strictly followed as we have seen cases of people falling through the crack and getting 1 year EAD when their priority date is far in the grey area (1 to 1.5 years from the current date)
Look at the bright side a 1 year EAD means that you will most probabaly be current in a year :D:D:D

For Indian immigrants in DC, this is a great opportunity. There are things Vayalar Ravi can do for you.

2. NRIs can not buy Agricultural land in India. Ask him why not? Local builders buy the agri land, rezone it and sell it to you for a profit. Why is Indian Government protecting middle men?

You mean to say CIR will be introduced to the immigration or judiciary senate committee or introduce directly to the senate. If it is introduced directly to the senate floor that will save a lot of time, on the flip side it will become difficult to add or change provisions if it is directly introduced to the senate bypassing the senate judiciary and immigration committee
Bills almost never go to the floor directly. Especially something as huge as CIR. It will go thru committee again and it will go thru normal rounds of debate and amendments between the 18 people in Judiciary committee.
Its very unusual for a bill to hit the floor directly without going thru the committee that has jurisdiction over it. If it happens all the time, then the committees would be meaningless. Hi,
I am in bit of a situation and trying to sort my options. I got my EAD, last month. Also took care of finger printing and received AP documents also. I 485 was filed in July 07. My I-140 is not yet approved.I am accepted to school in france for one year business course, starting Jan and ending Dec 08. Max I can fly back few times from France to US, for few days (In case there is rule for not staying abroad for more than six months). Plea
I am planning to either
a) Submitmy resignation and leave US by end of Nov 07 OR
b) take Leave of Absence from my firm for 15 months.
Is there a way I can continue my GC processing, factoring that I will be out of states for whole of next year.
Your suggestions are sincerely appreciated

Why dont you defer your business course for a yr.By that time you're I140 wld be most likely approved and then you wld have passed 180 days.That makes it easy for your GC to process.

per my lawyer you can come back from EAD to H1 by filing a new H1 petition (if its past 6 years on H1, then you need some basis like approved I-140 or old LC). You will need to leave the US and return to activate the H1. So thats always an option if you jump to EAD.
In your case, you can still file a H1 transfer, if it comes without an I-94 attached (meaning H1 got transferred, but status was not activated which typically happens when last H1 status ended more than a couple of weeks ago like in your case) all you need to do is leave the US and return some PoE where you will get hte new I-94
You cannot come back on H1 once you cross 6 years and you have switched to EAD. For you to get H1 extensions beyond 6 years based on pending GC , you should already be in H status. If you are not in H status (e.g. EAD or some other status) then you cannot get H without being outside for 1 year and being counted in quota again.

Need to travel via British airways. H1b visa is expired and need to get UK transit visa.
Any experiences on the quickest way to get this?

Please don't travel thru countries that impose this ridiculous transit Visa requirement on individuals, especially from India. Ask them to justify the charges, and you would get no response from them.
So, even if takes to spend $200 - 300 more, AVOID these crook countries that charge Transit Visa. People we must send the message across. In this century, I think its Indians that are traveling the most on these trans-atlantic-asia route, and collectively avoiding these 'snob' countries would send a very good signal.
If you are buying the transit visa, your dignity is at stake. Its like saying buying insurance for a person who is poor. They dont charge for countries that are more developed. so, AVOID AVOID these countries.
I am traveling to India soon, and I am going thru Brussels not because I got a cheap ticket, but because there is no transit visa required there.

The letter resembled the combination of request for admission and demand for records in the federal court proceeding. The Secretary of Homeland Security was given only three days to meet the demand. Apparently, the leaders of the DHS and USCIS have been struggling to work out some kind of solutions and thereby prevent thing going out of control as the records, emails, documents, etc. etc. can turn out to be very smelly and juicy depending on which side of the party politics one is involved. Under the circumstances, the leaders have been talking about various options with the departments and pending the discussions, everything has been on hold including the visa bulletin release schedules.
Yesterday, we described potential four options for the DOS and the USCIS. Unconfirmed sources indicate that the last option appears to be "out." Obviously there are still under a tremendous pressure to work out a solution before the three-day deadline of the Congresswoman's investigatory demand. It is going to be a very tense and stressful weekend for these officials.
