    hi mirchiseth, I recently applied AP to wrong location. I guess some one had the same situation while back. Do you remember how did that fixed.
    Basically my case is pending at texas, but i wrongly sected missory and so my receipt number says MSC, that is what i realized that it was efiled to wrong location. Any help in this would be appreciated.
    I also took infopass appointment to check, i am not sure if i get help with out getting the confirmation receipt as i efiled yesterday.

    There is a cut-off date. Until then they forward those applications to right center (it may take a while), check when is that.

    Call the office and tell them you did not get the answer to the questions and issues you raised and want to speak with the person who handles immigration policy matters. Follow up with this person. Letters go to junior staff and issues get lost unless you contact the senior staffers and seek appointment from them.

    I am going to India for couple months and plans to return back on AP.I am planning to get my passport Renewal in India.Is it OK to Renew in India as it shows my India address.

    I am not sure if they do police verification, even for renewals. If that is the case, there is potential for delay.
    I think, renewing in the US is a fairly simple process and in most cases be accomplished in 3 weeks. There is a separate question that asks for your Indian address, so that should not pose a problem.

    I have to agree with AngelFire here. There is a clear distinction between the EB2 and EB3 eligibility requirements. And who are we kidding, if your employer or attorney were willing to file an EB2 petition for you, would you be the "One category for all, Joe" that you are now, and demand that your employer file in EB-3 instead? Of course not.

    I'll admit it, I probably would have felt the same way if I was EB3. Being human sometimes makes us want others to not get what we don't have.

    I am amazed that there supposedly are people working at gas stations with valid EB2 petitions? And a "LOT" of them, too. I highly doubt that.

    There is a process and system in place to ensure the validity/genuine-ness of each application. If phony applications slip through that process, the process needs to be fixed and more checks established. I don't see how scrapping EB2 can fix that.

    I'll give you an example. I know someone that has an EB1 (NIW or EA, one of these two) petition in process. To the best of my judgement, I don't feel that this person qualifies (at all) to be an EB1 Green card recipient. And this person getting their green card before mine comes along, will cause some discomfort to me. But I can't let that bother me too much. There is a system in place to ensure that these type of things don't happen, and I would like that system to improve so that the people who truly deserve EB1 Green cards continue to have that option.

    I also know someone else that used the labor substitution option to get their green card within a year - start to finish. But this person was a genuine candidate for labor substitution. He had the necessary academic qualifications and work experience prior to the date of the LC, and the job was a valid one as well. He was a true example of what the labor substitution process was introduced for. Even if a large percentage of labor sub cases weren't as strong as his, I find it hard to hate everyone that benefitted from it, such as this person. It would be just wrong to say that this person violated any rules, because he didn't. Yes, I wish I qualified for some of these fast track options, but I don't, and I can live with that.

    The USCIS and any law enforcement officers have the right to ask you to present your registration document at any time. You should carry proof of your lawful status (such as your valid I-94 card, your green card, or your passport with I-551 stamp) with you at all times. If for any reason this is not possible, you should at least carry a copy of your registration documents.

    CAUTION: Failure to carry proof of registration (such as your I-94 card or green card) is a criminal misdemeanor and is punishable by a fine not to exceed $100, imprisonment not to exceed 30 days, or both. In addition, if you willfully fail or refuse to apply for your registration document, you may be convicted of a misdemeanor that carries a fine of up to $1000, or imprisonment of up to six months, or both.

    So it looks like we should atleast have a copy of the gc (shoved up our ...) and present it when asked by a law enforcement officer. Otherwise be ready to go to jail for 30 days.

    Very interesting. I thought affidavit from the mother or father along with a letter of non-availibility of birth certificate should be Ok.
    Ofcourse the non-availibility is usally given in a piece of paper and not any official letter head. There might / might not even be an official seal in many cases.
    Would be interesting to see what others think about your issue.

    Hi,

    I self e-filed my EAD application and the Receipt date is 6/7/10. They called for Biometrics which is done.

    I got an email saying that they have sent a RFE. Waited for 10 days, still no signs of RFE. When I called USCIS, they asked me to wait for 15 days. When I called after 15 days, they created a Service Request to re-mail the RFE. Now they say, I have to wait for 45 days. When I asked them if they will extend my deadline to reply to the RFE, she said she doesn't know.

    Has anyone been in this situation ?

    What kind of RFE will they send for an EAD extension.

    I sent my 485 receipt and a copy of my EAD when I e-filed.

    How many days do they usually give to respond to the RFE ?

    Any feedback is appreciated.

    Nikon was on the ropes the second they decided that they didn't need
    1) to update their DSLR's more then once every 3 years
    2) not to make their own chips but to outsource them from sony
    Its kinda sad that Nikon have to create FUD about their DSLR sales to create imaginary market share. I have it on good authority that their market share of the worldwide DSLR market is under 30%.
    The failure of the D2H to be even remotely competitive with the 1D Mk 11 even though both cameras had similar development cycles is simply a embarrassment.

    Visa is for getting into the country only, an expired visa will not invalidate your H1 status.

    We are talking two different things here. You are saying about AC-21. The OP is asking about retaining PD. The way you can retain your PD after I-140 approval is :-

    You file a new labor with the new employer - once it is approved - you need to file a new I-140 application and attach the old approved application with it - this would ensure that your PD will become the PD from the old case.

    Difference with AC21 is - in the case of AC21, you just switch jobs and your current GC process continues - you do not have to file a new labor,140 etc.

    If company is promoting and Apply for EB2, then the PD should be Promotion Date. Because EB2 qualification starts only after promotion. One cannot go back and get old PD and attach it to EB2 after promotion. That is unfair to people, who are already promoted and applied before. Hope this makes sense.

    But this should be neither , and the law allows porting. So if any body gets a chance to port, he should take it.

    AND BY THE WAY. GC IS FOR A FUTURE JOB,SO DATE OF PROMOTION HAS NOTHING TO DO WITH IT.
    SO I WOULD SAY THAT THE CONCEPT OF PRIORITY DATE IS VAGUE.IF U ARE IN INDIA, AND YOU PLAN TO MOVE TO US , IN 10 YEARS, A COMPANY IN THE US CAN APPLY FOR YOUR GC TODAY, SO THAT YOU CAN GET A GC IN INDIA , AND THEN MOVE HERE TO DO THAT JOB IN 10 YEARS.

    I applied at April 1st, In the receipt it says
    Received data 4/5
    notice date 4/15
    some lud on 4/29 and 4/30.
    after that no updates.
    My EAD expires 7/30.
    I am in EAD and I don't have any options. I start worrying more. Please help what we can do:mad:

    No LUD Update (NSC) for the last 2 days after FP. But EAD card has been ordered. Its very difficult to predict how they operate.

    Yep. I agree. For me and my wife, I saw LUDs the next day of finger printing. Don't know what this is. I don't know why the hell in the world they cannot post this information on their web site. Of course it can be confidential information, but they can create a system with very good authentication for that. May be they just don't want to share information?

    Right now we don't have any savings, paid off the car as of Oct 30th. I was trying to figure about the money which we are going to save from here on...I will take all your advice, sounds so logical and keep the emergency fund for 6 months aside.
    Coming to the city we live, it's a small place in Florida and not many employment opputunities for techie people. Like I said I am working for state while my spouse is consulting and travels every week (can't find a job in his area). We never imagined a management change leading to a risky and frustrating job situation, making us to repent our buying a house. Because the moment I stop impressing this new boss, we are out. Huh...I don't want to imagine that, because we will be left with a house we can't sell or rent (don't know if some one would want to rent it) and have to move.

    Well said adhantari.....When I look at few of my friends who married USC and how simple their became after that and how well they grew professionally, I sometime
    wonder why more folks don't follow that path.

    That is the advice I give to people from India in their early 20s who come to US.
    I tell them not to spoil their lives over the PERM-I140-I485. It sucks the energy of their lives. One will easily lose 15 years of their life without much professional growth.
