I had the exact same RFE. I'm on H1 since 1998, and you can imagine how many times I have left and entered USA. I have about 8 H1B extensions. Here's what I sent...
1). Cover Letter stating list of document to show evidence of law ful status in US.
2). I-94 card issued by CBP at the last port of entry.
3). ALL the H1B extension notices issued by USCIS. Its important that there are no gaps in dates on the extension/change of status notices.
4). passport copy containing all US visas and entry and exit stamps.
5). A document explaining the entry and exit dates matching the stamps in the passport.
6). Few pay stubs from the current H1B/green card employer that you are currently working.
7). Few W-2s for last few years.
Usually the I-94 that is on the extension of stay issued by USCIS is the same number thats issued by CBP at the Port of Entry. So, USCIS should be able to match the entry and exit information and extension of stay notices
I'm sure they know that one surrenders the white I-94 card when they leave US.

I have not been laid off and I don't have problems finding jobs; in fact my company has asked me to search for one more person with a background similar to mine. However I have been limited by the requirements of AC21. I was toying with the idea of leaving the country; but cannot sell my primary residence and might have problems obtaining a visitor visa for re-entry (to close on the house). I was seriously considering investing in some more real estate; but am holding back due to the random AC21 denials. I want to start my own business since I finally got my EAD this year - but with all the uncertainity of AC21 case approvals, I am not willing to put personal resources into a business in this country. Currently I am working on starting a free workshop for investment in my community - which will stop if my I-485 is denied in case my former employer revokes my I-140 (and yes; I did send in the letters for AC21). I have registered my dog with therapy international and volunteer my time for various causes (cabin repair, trail maintenance, public education) and donate regularly to the fire and police - all of these will take a hit if I have to leave.
I wonder what the reporter will conclude if he/she talks to immigrants who have lost jobs and have trouble finding new projects........

well..I have been waiting for my labor certifcation to get certfied for too long. just after Sep 11 I applied both for US GC and Canadian PR. My wife also applied for her GC. meanwhile her GC moved to regional when suddenly DOL thought it was time to regroup and there it went into BPC. In the meantime we got canadian PR some 2 years ago but we did not move thinking that we have jobs here.Then she got pregnant and lot of complications ( premature labor) and during those complications her company got acquired by another bigger firm who thought they don't need her..and result was job loss plus GC into the trash....meanwhile my labor certification even after 5 years was still sleeping in EB3 category(PD Oct, 2001) when i still have Masters( god knows why my lawyer put into that category)..Now my canadian PR was set to expire in march, 2007..so I thought i should decide fast..and i applied for jobs..and I got offer in vancouver with moving expenses paid from califronia..It has been the toughest decision because my employer is Indian here in california..and I have had good growth(10% average) but not the way I had wanted..I guess he also exploits..Indian exploiting another Indian..because they know I am not going anywhere..plus we work hard.. I asked him to match what was being offered in vancouver..and he started converting CAD into USD..well..it is not fair..So I have decided to heck with US and the Employer..and move on...at least I can come back..it is not an easy move because my son being premature child had lot of free facilities in california..hopefully he will get the same in Vancouver until he gets to 3 years ..and then it stops..
I have been in this country too long..and I guess one should settle down rather just wait for them to give GC...reading the other post about one lady whose EAD card got expired just tells me that how inconsistent this GC process can be and right until the end...

unfortunately, I think there is more demand than supply for EB2 India Mostly (maybe China too)...which will not let any relief be brought to any EB3 categories....If USCIS keeps allocating spillovers to EB2...they will never quell that demand.
I agree with Nixtor that dates for EB2 (I and C) will go back again..to at least 2004 if not later.

I have got FP appt notice 7 days back. I am July 2nd filer, filed at NSC, but transferred to CSC and then back to NSC. Also, got AP and EAD approved long time back from CSC.
I had seen a similar thread for NSC->CSC->NSC filers, but can't seem to find it anymore---did anyone whose cases got transferred to CSC receive FP notice?
I am a July 2nd filer, EAD/AP approved from CSC, case transferred back to NSC back in early Sept--still waiting for FP notice for over 4 months now.
PS: I am not desperate for FP notice---and i know it's going to be several years wait--just want to get the FP done and move to an apartment with lesser rent :-)

1- A document about the economic impact legal immigrants are making (H1, L1, EAD etc). It should include estimates of Federal, state, SS tax and sales taxes. You can also include estimates how we can impact economy by buying houses. Use the research document used by another organization someone posted yesterday to understand how such documents are written. Get some number crunchers and people with good writing skills in your team. There was a google group created by GC_peshwa yesterday. I think this group could do such proactive work. Set your timelines and work on it. You can post updates of your group on the forum so that others know about it and can join if interested. Once you finish the document, it can be sent as a release and also sent to reporters and lawmakers.
2. This group can also work on your idea from the post by posting on other news sites.

Yes the illegal reporters do provide a lot of fodder and in most cases the data can be easily debunked. I'll check their documentation and how they do research along with other volunteers. Will also check gc_peshwa's group. In fact the census generally doesn't give immigration status, do thats worth checking.

Were you part of the call yesterday on the Filing I-485 when PD is not current....we do have plans like these...and take part.

you need to call 800 375 5283 and then use 1 -2 -2 -6 -1 -Receipt No -1 -3 -4
this will take you to the IO at the office where your case is pending, so it will transfer you to an IO at either TSC/NSC. if there are no IOs available, then it will transfer you back to the national service center which is useless in this case. keep trying until you get hold of an IO at TSC/NSC only. the wait may be 15-30 mins sometimes, please be patient. this method is effective than the SR route.

I hope IV does push for the 485 measure but if for whatever reason they change there mind and dont push for 485, I would be disappointed but that will in no way affect my attitude towards IV. Over the past year or so I have seen enough of core tem to say they take a decision in the best intrest of IV.
I have not filed for I-485 and neither am I close. I feel I-485 is much more controversial interim relief then most members think. This is explained in a post (from a law firm) in another forum. Another reason for my feeling is that AILA is not supporting I-485 filing for health care: they are supporting a temporary 25K-75K increase in GCs. It is possible that health care GC does not have I-485.
You have to choose an issue that has a chance of getting through rather then an issue that most persons want or is logical. I will be surprised if I-485 filing as interim interim relief reaches the bill state and/or the bill gets approved in Senate + Congress.

I am in bit of a situation and trying to sort my options. I got my EAD, last month. Also took care of finger printing and received AP documents also. I 485 was filed in July 07. My I-140 is not yet approved.I am accepted to school in france for one year business course, starting Jan and ending Dec 08. Max I can fly back few times from France to US, for few days (In case there is rule for not staying abroad for more than six months). Plea
I am planning to either
a) Submitmy resignation and leave US by end of Nov 07 OR
b) take Leave of Absence from my firm for 15 months.
Is there a way I can continue my GC processing, factoring that I will be out of states for whole of next year.
Your suggestions are sincerely appreciated

It's a bit more complicated than that:
Law comes from three sources:
Comman Law: Laws inherited from the british justice system (evolved over centuries).
Legislative Law: Laws passed by congress and signed by the Prez.
Regulatory Law: Regulations created by the regulatory agencies to implement the laws made by congress. Congres doesn't always finalize all the details to the last comma and leaves that work the relevant government agency. For example, FCC, SEC create regulations about how the congress' laws are to implemented. These regulations have to conform the laws passed by congress. These regulations have the force of law.
So when congress did not stipulate any specific overflow mechanism, it left it completely up to USCIS to work that out.
Historically EB2-RoW overflowed to EB2-India and EB3-Row overflowed to EB3-India. Soon after EB3-RoW was retrogressed, USCIS channelled EB2-RoW to EB3-RoW. This is expected to continue till EB3-RoW becomes current itself.
Therefore, if you're looking for any progress in PD, whether EB2 or EB3, the key parameter you should be watching is EB3-RoW cut-off. Only when this becomes current, others can even _think_ of nirvana. Without overflow of RoW's, both EB2-India and EB3-India cannot progress more than a day in every bulletin (at a average). EB3-Row moved a month and a half in Jan bulletin, which counts as a progress, however small, for everyone. That holds true -though not easy to intuit- for EB2-India as well!

Thanks everyone for being patient and supporting us. The work is happening at all ends and it is an uphill task.
We really need to increase our membership. Higher membership will mean us looking tall when we meet lawmakers. Please all try to help us spread the word of IV to everyone you know that is stuck in retrogression. We represent at least half million people but we currently not even have 6 thousand members. Thus we have to bring lot many people into IV. I would encourage everyone to pls. register on this forum instead of being visitors.

but the point is I sent my docs to my employer and I didnt include any G-28 in it..which means we signed as we prepared all docs..
Now can they attach G-28 and introduce themselves as representatives and swallow all receipts???

Funds, There are more ideas than funds. For every new campaign, plan, we need funds. So it is an ever needed commodity. We can do a lot and lobby effectively, we just need more funds, plain and simple. Inspite of several hundreds contributing, it is not enough. Remember IV is a non-profit, so every penny is accounted for. People handling money (core IV) are sincere, honest hardworking people on work-visas, they have much to lose from not being accountable. And the most important thing is, please take a look at these hard-working IV CORE PEOPLE, please. Some of them have put thousands of dollars (I mean 5 and ten thousand) into this effort. I am not counting personal expenses, travelling to DC, lost work hours etc.
So your $100 at the bowling arena, or $50 at dinner or $35 bouquet wont get you much farther, but your recurring contribution to IV will.

Would request you to elaborate a bit.
Note that I am not using either my EAD or my AP. All I am using is H1-B and my Canadian Passport to enter and leave US. Most people on the Canadian US border to that.
Also, I commute to US everyday to work, which is less than an interval of 12 hours.

Hi I am a student in United States and I was on Optional Practical Training from Jan 2008 to Dec 2008. As I finished my OPT in Dec 2008 I joined again in New course for M.S in soft. Eng.
In the month of November I got a job in California through an employer, who is based in New Jersey. As I got a job the employer asked me to sign a contract which states that I will be paid 60,000 per year and I shouldn't work with his clients for 1 year after the agreement is terminated.
As the project was only for 40 days I finished it successfully and I my employer couldnt find me another job till now. So I decided to work on my own when I got an opportunity with the previously worked vendor, when my employer came to know about this he has threatened me to sue me. Then I retrieved from the opportunity but now even my employer doesnt pay me anything. It is been 4 months, he hasn't paid me anything , even he hasnt provided me any insurance.
I asked my employer couple of times to terminate my agreement otherwise I would go to Department of Labor and claim my wages but he downplays that by saying I am not on H1B so I will not be paid unless I am working with Client. But the agreement didn't say anything like that.
I have even asked him to run the payroll where I worked .I.e in California but he ran it in New Jersey. When I pointed this to him he said the payroll will be run at the residing state if the employee works more than 6 months.
We had an argument about this but he never replies to my emails he only calls me and says whatever he wants to say but when I ask him to put whatever he has said to me on phone in an email he doesnt reply at all.
And to mention, he doesnt have any documents of mine. I even didnt fill any I9 form, what ever he has is the only agreement that I signed and social security number that I emailed him to run my pay roll.
After the argument I even requested him to send my original agreement signed by two parties. I only had the agreement signed by me, he even didnt send me the agreement with his sign on it even after repeated requests.
Now he doesnt even care to answer my calls or emails. I am really tensed. I am getting opportunities from vendor that I worked with but I am afraid he would sue me. Please help me What to do. I am really really frustrated, tensed and I can't express how I feel right now.
I want to get out of the contract and work with the vendor if Possible.
Please explain me how can I tackle this problem?

1. You have two hands and two middle finger...just show to him and move on.
2. Or call the DOL and inform all...and he will be in soup.
Put everything in e mail or certified mail and pass all those information to DOL and move on.
You dont have to bother anything else.
