Search immigration.com ("i-140 denied, urgent help please"). I went thru this, attorney was so-so, not experienced in handling cases like this as he is a small firm. So I went to one of the BIG firms and got it MTR'd and cleared in 3 weeks. I spent 3K, but never thought about it before or after.
While you work on backup options, dont just let go the current status that you got in 4-6 yrs.
The new attorney could easily make up for the pay.

The coming back of CIR seems imminent - we need to step up lobbying/calling/faxing/writing. Is IV still have the lobbying firm support? do they have any specific suggestions so EB friendly amendments will be introduced/succeed.
With dates being current I think everyone will say - hey employment based system does not have backlogs why increase their numbers. This priority date movement is so complex its easy to mislead anyone.

There are over 339,000 people stuck in name check - this is done for naturalization and 485. I can bet you this will be the next battle because a lot people who have filed 485 will get stuck in this black hole, where this no accountability by FBI to individuals because the "client" is USCIS and last quarter there were 400 law suits (Writ of Madamus etc) to force USCIS and FBI to do their jobs. It would be best if setting time limits for name checks are included in IVs goals now itself. No point in jumping from the frying pan if one is going to eventually land in the fire. The name check snares a lot of Indians, Chinese, middle easterners, russians etc. Most people stuck in the name check have never been involved with the law - go figure the algorithm FBI uses to trawl the ocean bed!

I heard that NSC is 45 days compliant in processing EAD. Is this true? I think it is not. Knowing NSC, it could take approximately 90 days +/- 30 days.

Thanks for your post. It's good to hear the perspective of a core member of IV like yourself. I understand your point of view but respectfully disagree with your definition of the greatest good. The greatest good will not be achieved by just passing the labor cert. stage. The greatest good is achieved once we have the GC card. Your effort on retrogression to benefit 250k & 200k is plausible. But you help them to pass one bridge, to just get stuck on the next. If there are 25k people stuck in name check at this time, imagine what will happen when the estimated 200k-250k reach that stage.
If the 25k spent in average 3 years in the name check, what will be the wait time for that massive population that are headed that way after retrog & labor cert? The EB process is a big picture and the greatest number will not get the greatest good until all these obstacle are resolved all the way to the end.

1) A Serious Majority of the IV members are affected more by retrogression+labor as compared to FBI name checks. and
2) IV core members have full time jobs and spouses and are working pro-bono for the good of everyone and money collected is also coming in slowly and thorugh the IV members themselves.
These 2 facts mean that both time and money is at a premium and they have to spend it solving the problem they originally started to solve. Believe me, some of the core members themselves are stuck with the FBI name check issue for the past 2 years or so.
Given all these facts, you have to understand where IV and it's mission/policy stands. To my understanding the policy is "One step at a time".

Guys, what about July 2007 filer. I filed my 485 then without my wife's name as she somehow could not join me then. I am hoping that as soon as my dates are current, I'll immediately file my wife's 485 on the first day of the month. Hopefully that should include her in my app before its approved.

Unless you have been found to commit criminal fraud, it should not affect your green card petition. Small penalties and the like have no effect. Last year I had to pay a small penalty because I underestimated my taxes deducted during the year.
You are getting an audit for the 2005 year now? I would have thought they would have moved on by now. Did you take an extension and file late last year?
You can expect it anytime. The retention period is 7 years, so keep all your tax filing papers and all related docs for at least 7 years.

Given the hopelessness of the situation in March, switched jobs and was unable to file labor for a variety of reasons. Now everyday I see people come over and tell me how they plan to switch jobs once the 6 month mandated hibernation is over...I feel like breaking something. Lot of them have even stopped working, confident that a new job awaits :mad:

This is how it should be done...
- request USCIS to port your PD from already approved I-140 from past employer
USCIS may or may not do it for you
- if not apply for I-485 using Category of 2nd (should be EB2) and PD from 1st one. You need to attach both of these with I-485 application and of course a covering letter stating what you are doing.
Here is the extract from the law -

There is nothing funny about our state in US. Unless the humor is very dark the relevance will be lost. The idea can't bee to make another Monsoon Wedding.
There are many ways of telling a story. It can be either with humor or sentiment or any thing else. If we are presenting a story that was meant for telling problems (like h1b/GC process) presenting only problems will not achieve our goal in publicity. Show something that audience like (most of people like healthy humor I think) and include your concept/problem in that so that it will get in to people. Otherwise it will be so called award movie with lot of tears and sadness. Even that would work if it was presented with lots of creativity.
Any way problems are not only in US and they are there everywhere. I am also struggling with these Visa issues (GC waiting since 2002), but that doesn’t mean I haven’t had any humor in my life here in US. I didn’t understand your comment against movie like monsoon wedding. Please elaborate.

You dont have to pay any taxes for tranfering money. It looks like you are supporting your parents by transfering your savings to their account.
Since the account is in your parents name and i am guessing you are not a jt holder since that is illegal in india. A NRI and indian resident cannot be joint holders of an account.
If you were transferring it to your nre or nro account in India then you are supposed to report the account information using FBIR form( if sum of amount in all acounts > $10K) and pay taxes in US on the interest earned in those accounts.
I was not doing it initially but for past 5 years i have been paying taxes and past three years reporting all my accounts to IRS.
