While having Vayalar Ravi talk to US Govt. on social security taxes is a good idea having him talk about retrogression is a very bad idea.
Permanent residency and retrogression are internal affairs of US of A. USA and USA alone will determine who gets their PR and citizenship. Any foreign official touching that subject will be seen as infringing on this nation's sovereignity.
During the 60s USA wanted lot of doctors and imported them from India. Later on they started producing their own doctors and we know how difficult it is for an Indian doctor to emigrate now. I suspect computer programmers are the next. The current focus is on importing nurses and when they have enough nurses they will have the same problem..... Isn't life very fair ?

As per USCIS official report as of end-August, there were more than 500,000 pending AOS applications:

I am in a similar position and am going to wait till the end of the year for the AP. I am hoping to be able to go for the H1B stamping with the AP. So if there is any problem with the H1 I can atleast re-enter using the AP. Its a nice backup...

I got RFE through attorney. It is asking following details
1. Emloyment verification letter with present and intended permanent employer
2. Last two months pay slips
3. "Although your I 140 petitioner indicated in your initial I485 filing that you were employed by company A at that time, your Form G325 indicated that you were employed by company B and you were authorized by B at that time, please explain discrepancy"
I am bit worried about question 3. I worked for company A and labor, I140 applied when I was with A.
But during I485 filing I was with company B and in G325 I mentioned that.
It looks like company A by mistake mentioned that I was still with them.
I called my attorney he said its upto me decide which company I should work for.
But I am not sure company A provides an employment letter for me because I am working for comapny B now.
If B provides employment letter since it is >180 days since I 485 applied, will there be any issues?
Please give your opinions...

I am sure lot of us who are stuck in this GC mess like you can relate to your frustration and must be looking for a backup plan. There are certainly other attractive options like you mentioned if one does decide to jump ship and frankly I have done the same. Should this GC issue not get resolved in a reasonable amount of time, I am fully prepared and ready to jump off of GC wagon. I suggest we all do that.

Employers know that we are not going to budge from our jobs to maintain the coveted priority date and the government is in no big hurry to reform the system as they can collect taxes from us without being accountable to us.

I have reached the conclusion that I cannot bear this uncertainty any more and therefore, I am pursuing other options. Ciao...Good luck to all those waiting for a GC!

We are talking two different things here. You are saying about AC-21. The OP is asking about retaining PD. The way you can retain your PD after I-140 approval is :-
You file a new labor with the new employer - once it is approved - you need to file a new I-140 application and attach the old approved application with it - this would ensure that your PD will become the PD from the old case.
Difference with AC21 is - in the case of AC21, you just switch jobs and your current GC process continues - you do not have to file a new labor,140 etc.

My employment offer letter has everything but the job duties but the job duties I can get from HR at anytime. In fact we have automated system that can generate all these in a PDF that the HR person can sign.
I am thinking that combination of offer letter, Job verification letter signed by HR, last pay stubs from previous employer, AC-21 memo and a cover letter explaining the portability provision should be enough.
The problem is my attorney is insisting that the letter that they sent for my employer's signature is "required" to successfully respond to this RFE. Is it really true? I have seen other posts where IV memebrs sent a very simple EVL and stuff.

Initially my case status was like whatever you said..but I got the FP and done. Now the case status says bit more like
On September 18, 2007, a fingerprint fee biling notice for this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was mailed to you stating the reasons for the billing and the instructions to follow to submit the necessary payment. Therefore, processing of your case is suspended until we receive the necessary payment along with the billing notice we mailed to you. If you have not received this notice within 30 days of the September 18, 2007, please call Customer Service at 1-800-375-5283 for further assistance.
Does anyone know in the same boat?

Based on what you believe that "BC has a much higher standard of living than Boston?". I hope that is not one of those silly annual surveys in which they interview low income and beggars on the streets and rate mainly based on health care and welfare for them.

These are just guidelines from a law firm. Most of the law firms were making money in porting cases for last two years, as number of new applicants were less due to economy. That does not mean that USCIS is going to approve these cases based on number of years of education. Porting within a company is a risky deal. Even though lawers dont make it sound like a big deal, for getting new clients. The old eb3 job that was used to file the first labor needs to be filled. If you are working with a desi bodyshop, be careful. You are inviting an audit.

We applied for H1B transfer on Jan/02/09 (California Service Center - Premimum) and attached pay stub and employement offer letter. First time we did not attach any contract details.
We got an RFE on Jan/09/09, Basically they wanted to know whether i am working on project currently. They are asking to submit contract agreements, client details (client letter - not sure it is must or not).
There are 2 layers between client and my employer and could not get client letter. However, I can provide the following docs,
1. Contract Agreement Between Employer and First Layer
2. Contract Agreement Between First and Primary Vendor
3. Letter from Primary Vendor (stating that i am working their client project).
4. Primary Vendor Invoices to Client
5. Time Sheet (Client approval)
6. Access Card
7. Work site Photo
8. Copy of Client WO (end date is 11/21/2008) - client with PO amount and end date is doest not matter... (i am not sure how is uscis will take it).
I could not able to client letter due to their policy. What do you guys think on this case approval. Any reply is highly appriciated..
