    I have similar situation - I applied for 140 in July 2006. My daughter will turn 21 in July 2007. As I have applied for 140 before she turns 21, she is safe for GC, but will loose H4 status when she turns 21. As per my lawyer's advice I have applied for her F1 so that she can stay and continue her studies in US. When I become eligible to apply for 485, she can be included in the application - but, not as a dependent of H1B holder.I urge you to ask for second opinion. From my understanding it depends how long your I-140 was pending.

    In addition to the direct beneficiary family-based preference category examples provided in the previous memorandum and above, section 3 of the CSPA also applies to derivative beneficiaries in both family-based and employment-based preference categories. Just as with the case of the Form I-130, with an adjustment based upon an approved Form I-140, Immigrant Petition for Alien Worker, [and other immigrant petitions filed under section 204 of the Act for classification under sections 203(a), (b), or (c) of the Act], the beneficiary�s age is to be calculated by first determining the age of the alien on the date that a visa number becomes available. The date that a visa number becomes available is the approval date of the immigrant petition if, according to the DOS Visa Bulletin, a visa number was already available for that preference category on that date of approval. If, upon approval of the immigrant petition, a visa number was not available, then the date for determining age is to be the first day of the month of the DOS Visa Bulletin which indicates availability of a visa for that preference category. From that age, subtract the number of days that the petition was pending, provided the beneficiary files a Form I-485,3 based on the subject petition, within one year of such visa availability. The �period that a petition is pending� for the Form I-140 is the date that the Form I-140 is properly filed (receipt date and not priority date) until the date an approval is issued on the petition.

    when I reached DC on Monday. Countless "Airborne" tabs in water during the day kept me going for the lawmaker meetings(I did 95% of the talking), the reception on Monday evening and the rally.

    I cannot explain the experience felt at the rally. There were infants, small children and many many strollers. I took pictures of all of them (will upload during the day).

    I was thrilled to meet "macaca". "guyfromsg" was awesome with his spirit all throughout. Chandu sported dark glasses and looked awesome and he was still charged to get more people to the rally.

    It is very unfortunate that many of you just squandered such a great opportunity to be part of history. The 1500 numbers floating around is not true. There were more people than that. We will know soon from IV core.

    Greg Siskind sported his IV TShirt and he was proud to be taking part in the rally. He spent a lot of time with IV.

    "NeedHelp" came with her 3-4 year old daughter who is quite sweet and sat at the first row at the gathering on the lawns of the US Capitol.

    July 23rd filer. NSC>CSC>NSC. Did not get FP notice and will be travelling to India this friday for 2 months. So called up Customer service and opened SR for both me and wife on December 20. Got appointment for me for Jan. 16th but nothing for my wife in the first week of Jan. Then a week ago got a second set of appointments both for me and wife but now on Jan. 18th.

    Anyways, reported to USCIS office in Des Moines today (Jan. 16th) per original letter. Wife accompanied me and I had all the appointment letters with me. Explained to the security guy (a very nice old gentleman) about the situation with upcoming travel, etc. He went and soke with the USCIS manager and she was gracious enough to allow my wife to get her fps done with me. Was out of the place in about an hour. They had a new machine installed and the person from the machine manufacturer was demonstrating how to use to the local staff, so we were all guinea pigs. Scanned four fingers from left hand followed by thumb, then four fingers from right hand followed by thumb, this was followed by each finger individually rolled across the scanner, then took FP of right index finger and asked me to sign (similar to a credit card digital sign box). Took a photo and that was it.

    One piece of interest to people who for some reason missed theit appointments and forgot to reschedule. I was informed by the security guy that there is a grace period of 87 business days after your initial appointment date for you to walk-in and get your fps done. However, you need to call the center to find out what day of the week is alloted for walk-ins. (It is Wednesday for Des Moines office).

    If you have multiple appointments for different days (like I had), go to the earliest one if possible and get both the notices stamped with the stamp indicating that biometrics were taken on that date.

    You did not earn red mark...my comments were more on humane side to not worry too much about anything.
    You are right, we need to be cautious, lest things go wrong and feel sorry later. You (IV) all are doing great work. I love this site.

    I fully agree with you we all are frustrated with this mess, but my idea is...For many things as many can go wrong....there will be equal if not more things turning right.



    Off topic...here is a question for you, how does one becomes a member from junior member and so forth.

    2000-2002 was worst. Who didnt do job search during that time have no idea how it felt like.

    I just came out of school then and it felt like sky is falling on me. Becoming desparate to survive, i went to work in a gas station. The lady owner didnt pay me after i worked for a week saying i am not concentrating enough. Then out of no where i found a technology job that paid 17$ per hour to keep me going and they did my H1 a year later in 2002. It just made me more strong i guess. But, it is a hell of an experience. Most of my freinds went for second masters or PHD to Keep the status.

    It was so hard to find a job those days. I was myself unemployed for so many months along with a lot of my friends and everyone of us was highly qualified and experienced. Since 2002 end onwards everyone of us has a good job without any breaks.

    I hope we don't get to see the 2001 recession again and I am sure it won't be that bad this time.

    It is the financial sector which is paying for its own mistakes. It might spill over to the other sectors of the economy but not to the degree it happened in 2001. Just my opinion.

    I have changed jobs after 180 days of filing my AOS, although it's in the same of similar classification and my attorney from the new company informed me that time that USCIS is generally very liberal with the "same or similar" classification, as long as the job duties don't change totally.

    1) Do I have to ask Company B to apply for anything relating to my GC? I want to make sure that they know and agree to all costs associated with the paperwork? Dont want to end up paying from my pocket as I have heard in a few cases before

    -- They may want to file an AC-21 letter ( stating that they have permanently employed you for this position for this salary yada yada yada ... ) and definitely a G28 to change representation on your cases in case of any RFE and other communication by USCIS.

    2) I believe since my I-140 is approved for more than 180 days or actually my I-485 being filed for more than 180 days, I am allowed to move, correct?

    -- Yes, albeit to a "same or similar" job.

    3) Since my I-140 is approved and I have an EAD, can USCIS/Company A cause it to be revoked? OR it doesn't apply to my case?

    -- USCIS has no business revoking your I-140, it's your previous employer's property which they may revoke at any time ( due to various issues, not necessarily to get back at you )

    4) Do I need to ask Company A to maintain anything? Or just keeping good relations with them is enough :)

    -- Keeping a good relation never hurts, but company A doesn't have to maintain anything for you. Good luck in your search !

    Guysssssss N Gals , I got it (I-485 approval) 10 minutes ago!!!!!!!!!!! NO RFE. Recent Luds were on I-140 / I-129 / I-131 ( Luds occered on 10/29 & 11/4) . Been in USA (F1, H1) since Aug 1997.

    Are we doing anything to get the support of orgs that are not community based ? I don't see how getting the support of an org based on an ethnic community "broadens the base".
    Well, the actual goal is advancing our cause. This endorsement will actually raise awareness about our organization - I guess, that does not qualify as broadening the base for you! But, whether it broadens the base or not - it definitely advances our cause!

    And, while somebody is actually doing something,what are you doing about advancing the cause?

    This particular support actually helped advance our cause a lot, much more than can actually be revealed on Forums. So pipe down, and do something creative! Why don't you try to get the support of the non-ethnic organizations - call the IV core group to offer your services, and get cracking on it!

    That is a good sentiment, Bkam.

    Please don't mistake BerkeleyBee's post. From the point of view of the core team, many posters have ideas that seem correct to them and they post 'This is my idea, why can't we do this?'. In plain language, that translates to 'Why can't the core team do this?'.

    So from my point of view - simply as someone who has been posting for a long time in Usenet, newsgroups etc - if you have a good idea, implement it yourself. E.g., if you want a webfax that thanks Senators, write the webfax and post it. Sample webfaxes are available on the website, customize it and post it. The "core team" is human. We are balancing full time jobs with the web site and it would help if people making suggestions also implemented it.

    In this idea that has been posted re: educating people in other countries, that is NOT part of IV's mission. IV's mission is clear: it is social service to people that want to get a green card. It is also social service to educate prospective immigrants about the delays in the GC process. However, that is not part of IV's mission. It can be part of Bkam's and Learning01's personal missions, however.

    I think the one additional thing is also that we need to using harsh terms to blame the U.S. system or Congress for our problems. Lots of people have problems, Congress has limited time to tackle everyone's problems. As someone prominent that we met said 'War on terror, injustice to immigrants.. You know what is going to win every time'. So let us keep perspective and soldier on, remember we are also getting prominent, so now is the time to present ourselves and the forum in the best light possible.

    Thanks in advance for any suggestions you can provide

    Here is the current status:

    - Consulted my lawyer and went thru all docs they submitted as part of my I140 package. On my last employer experience, found out that I had submitted only one affidavit from a co-worker and that would cover for less than 60 months of experience at my last my place.
    - Came up with a list of some 30+ documents that include paystubs from US/India, W2/Form16's, letters submitted to CIS by previous company for new H1b back in 2003 and then for an extn in 2006, appreciation letters and other material on previous company letterhead. Discussed this with my lawyer
    - Lawyer is of the opinion that we can prove our case of alternate evidence based on documents i am producing.
    - Plan is to submit an affidavit from me that i was unable to get an exp. letter from my previous employer mentioning reasons on why its not possible, submit 2 affidavits from ex co-workers covering span of 63 months.

    Based on your scenario or known people, can one of you respond to how should i approach following issues:
    1) I am going to draft content for experience letter non-availability. I have mail trail from last 1 year following up on asking for details of $12K. Same mail mentions that am asking for experience letter and provident fund amount back from HR. Will it be a good idea to attach deputation letter mentioning 5 lac indian rupee to be paid for breach of terms and a 100 rupee bond paper contents which i signed before US deputation. Will it be Ok to mention that previous employer is asking for $12K settlement amount to provide experience letter and attach copies of bond and deputation note OR only mention that am unable to get experience letter and i have been following up with HR for last 1 year and attach email trail as evidence. Any pros and cons from CIS perspective on which approach to choose.
    2) Any other documentation that needs to be submitted ? Supporting evidence alongwith company lawyer detailed letter, 2 affidavits from co-workers for skills and duration, self affidavit for experience letter not available will be -
    > Paystubs from US/India, not for all 63 months but for some months in 2004/6/7/8.
    > W2's for 2005/6/8.
    > Form 16 for 2005-6/2007-8
    > Offer letter, yearly appraisal letters, US deputation letters, appreciation letters, ID Cards, 3 Business cards showing change in designations.

    I was not bragging. I was just thinking out aloud, so to speak. Economic ups and downs like this this are a normal part of economic cycles in a capitalist economy. My observation is that IT industry is not as badly affected as other sectors. I have not seen people sitting without jobs for extended periods. I mean, some people do loose jobs but they get something else within a couple of weeks. That is pretty much normal functioning of markets.

    This is not your normal recession... Whats happening right now is once in a lifetime event... This is the kind of stuff you will be telling your grandkids about! This is payback time of the excesses of the past 25 years of loose monetary and fiscal policy under Greenspan... Your observation about IT industry not being as badly affected is true only till the month of October... Till then things were in sort of slow motion esp in IT sector... Not anymore!

Americans to a large extent have not known what real poverty is... The social implications of this fall out are going to be awfull... Don't take things for granted... If you thought that cushy job of writing apps for Facebook is safe, boy you are wrong... The depressionary train has already left the station and all we can do now is sit tight and watch!

    Call all doctors in your area. When you call them, make sure they put you on their waiting list(in case somebody cancels).

    I would even drive 3-4 hours to find a doctor for the medicals. Without the 693 you are asking for a rejection.
