I had a delay on a clients site, they needed something changed which took all my time. Business comes first. Here is my entry. I am dissapointed that my notebook PC won't be finished until Friday/Saturday, was looking forward to using it in the battle. The 3D Render was made by me.

As per Murthy's announcement AILA finally managed to get the required number of Plaintiffs by 2:45 PM today after noon.
Still to be on the safe side shall we go ahead fill the PlainTiff form ??
what if the lawsuit is not given " CLASS ACTION " status and only Plaintiff's are benefited ?
Is there any potential advantage for AILA if they upgrade the status as CLASS ACTION - do they get any Money ??

Its is always advisable to file the petition as AILA clearly stated that they are going to identify "class" of people. The court may or maynot give benefit for all classes .so better file and be in the "Best Class" where if AILA wins the case you will get benefited ,Dont be penny foolish as if you already spent money in getting other stuff ..what you are loosig in 1 grand for attorney fee , ( think of desi employers who gets 2 grands every month on you )
Also with todays's rumor some thing positive is in pipeline ..even july VB flip-flop also started as a rumor

Here is what I found from Murthy Forum --
According to the AILA-NSC Liaison minutes of 04/12/2007, the following standards generally applies in determining EB-2 requirement:

I saw this on an anti immigrant site by a M*****r.
Hope some of you will learn a lesson from it and stop posting threads about Telgus, Eb3 vs Eb2.
I have also seen posts by ignorant educated illiterates on IV where they advice people to do illegal things. Some of you own consulting firms or businesses and try to promote it by posting and sending Private messages. If we see such message, let us give reds and report to IV. We also need to discourage people from answering wrong info to posts where someone is illegal/out of status. All this used against us.

Lets get some media attention on how the GCs are wasted and how we suffer for years.
Let the public know how much injustice the people from backlogged countries are facing..
We don't contribute less. We work no less than others ..but yet we are discriminated.
I wonder why they don't have 7% cap on H1B . And all this stupid media says people from ...... are stealing jobs and ....... overstay:mad:

The name check takes 2 years anyway, making a mockery of fast processing times. Even VSC, which is the slowest, takes less than 2 yrs for 485.
Wait a minute; I thought the name check is part of the I485 approval (and for those who file I-140 and I-485 concurrently, part of the I-140 approval). It wouldn't make any sense if the I-485 is approved and they are still checking the identity.

Yes. 2001 to 2002 was the worst period as far as job market goes. I know, a lot of my friends left the country and went back to India. I was without a job for 5 months in 2001. Luckily, I had a secure job during 9/11 and afterwards. But, if 2008 is going to be anything like 2001-02, everyone should start preparing for it. Most of the members in IV might have an option to port their jobs, thanks to AC21. But, there are so many unlucky people who will have a tough time. From my past experiences and based on the current market, I think, banking is and will be the worst hit sector. Food Products, Medical, Insurance industries should be ok.
I had a lunch meeting with the President of my consulting Company.(This is an american company). She met with a few CIO's and gave us their view points. Most of these CIO's are going to budget for new projects and products for this fiscal year and beyond. But, they said, they will be cautious in actually using the budget so early in the year.
My personal opinion, If anyone is planning to use AC21 to port jobs, please do so carefully. If you already have a stable job, it would be best to hold on to it, instead of looking for better pay at this time.

The greatest good will not be achieved by just passing the labor cert. stage. The greatest good is achieved once we have the GC card. Your effort on retrogression to benefit 250k & 200k is plausible. But you help them to pass one bridge, to just get stuck on the next. If there are 25k people stuck in name check at this time, imagine what will happen when the estimated 200k-250k reach that stage.
If the 25k spent in average 3 years in the name check, what will be the wait time for that massive population that are headed that way after retrog & labor cert? The EB process is a big picture and the greatest number will not get the greatest good until all these obstacle are resolved all the way to the end.

Can someone answer this? If you get your EAD before six months of filing, do you still have to wait 6 months to benefit from AC21? Or, can you change employers immediately after you get EAD, without waiting 6 months?

Is there a conspiracy, first there was delays in the processing of the EADs, now there is delay in the production of the EAD cards...

My EAD renewal took almost 90 days to get approved, and my employer was ready to let me go if I did not get the approval before my EAD expired. Just made it with 2 days to spare.
Why every discussion has to end with donate - why donate? What IV has done so far? Where the money goes? EB2 vs EB3... etc. Stop hijacking threads.

You can try calling USCIS and explaining the situation. Make sure to tell them that you are dependent on the EAD for employment so ensure that they do not revoke the existing 1 year EAD while in the process of granting the 2 year EAD (If they do that)

Nobody from IV has prevented people from other countries from speaking up. On the contrary, multinationalism is only encouraged to give a global face to this issue. But, I don't see anyone from outside India/China bolstering IV's efforts. Why don't they step up and join the core team?

Yes, Norman Matloff goes over IV once in a while to know whats the current "in thing", he mentioned this once in his newsletter.
